Ah, that changes things. Merely having an interview in London doesn’t have any impact on your success. You are interviewed as an individual and based on your individual circumstances. The high approval rate from London is not because the people live in the UK. It’s a natural result of the statistic that people from economically advanced countries are less likely to commit visa fraud as they would have no real economic advantage moving to the USA under false pretenses. Also TB is less common in the UK than other countries do we don’t see many denials - if any - for that reason. 

 

Since you have previously been denied and a waiver was rejected your case is obviously not as straightforward as most. Curious as to why you re-filed a K-1 and not a CR-1 where you would fall under the category of immediate relative and there is more tolerance towards inadmissibility factors.   

When we consulted our attorney, she advised that the CR1 isn't necessarily looked on more favorably than the K1 in regards to any inadmissible factors. We were also told that the time frame for the K1 was faster than the CR1, we have been apart for 6 years and just wanted the fastest route to getting him to the States. Unfortunately, it seems like it has taken even longer.

Attorneys are known for giving the advice they want you to hear, not what you should hear...it’s too bad that happened to you. CR-1 denials can be appealed, K-1 denials can’t. 

 

I understand how you feel. My husband was denied a UK spouse visa and given a permanent ban (he can’t even visit the UK) because of his criminal record. I did all the traveling because he couldn’t come to visit me. After the denial we then had the wait and expense of the CR-1 but it’s all been worth it in the end. I’ve been here 20 months now.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Depending on why either the K1 or CR1 was denied both can be appealed. USCIS will let you know if your denial qualifies for a waiver of inadmissibility. Which is another long drawn out, expensive process. 

 

Honestly, I would rather live in the UK. I'm a registered nurse and want to study midwifery there. Unfortunately, my daughter's father filed an injunction to stop me from leaving the country with her.
