Expert's Advice on my IV & AOS packet

 

Hello VJ member, this site has been invaluable for getting information. It has also helped me keep my sanity in the "hurry up and wait". I am ready to send my package to NVC package. I received 08/20/2018, paid the AOS bill and awaiting the IV Bill and DS-260. I have my AOS and IV packages ready as below, just missing the employment verification letter. I the Petitioner am sponsoring my spouse (CR1) and stepson 17 years old (CR2). The IV and DS-260 are still pending. I, the petitioner am the sole sponsor on the I-864 for spouse and stepson.  

 

Here are my questions:

1) In some of the older threads, there is a mention that I need to include 2 (2x2) passport pictures of the beneficiary in my packet, is that true?

2) I am US Citizen residing in the US, I assume I do not need any domicile documents?

3) My Document Check List, it list both the IRS Transcript and Federal Tax Income Returns. I assume I only need one or the other. I just pulled the tax return transcript from IRS website.

4) Should I send any “ proof of relationship”. Ie. Chats, pictures, phone records etc…?

5) Cosmetics – All my documents are copies and are on 8 1/2” X 11” paper. Should two hole top punch all the documents? (I have stamped all documents with case number)

 

Packet 1 <Spouse> in one Manila Folder (AOS/IV) separated by a bottom tab. AOS cover on manila folder & in each section.

Packet 2 <Stepson> in one Manila Folder (AOS/IV) separated by a bottom tab. AOS cover on manila folder & in each section.

Sorry for the long post & Thanks in advance for your valuable input. 

The 2x2 US passport size is for the beneficiary which she will bring to the interview. Other supporting documents are evidence of bonafide marital relationship you have both gotten since after filing the i130 which includes chats,photos,call records,more visits etc.

 

Again,your proof of domicile includes Lease/Mortage agreement as well as Utility bills.

You don't need any of the above items:

  • Petitioner's US status is already established when the I-130 is filed, you don't need to do this again.  Joint Sponsors on the other hand would need to provide proof of status as it would not be previously known.
  • The NVC will not need the petitioner's passport bio page, the petitioner's birth certificate, or those other items you mentioned.

I lined out the W2's because you don't need them since you are sending tax return transcripts.

Incorrect.  Yes, the visa applicants will need passport photos for the interview but also as part of the "IV package".  A US Citizen PETITIONER signing an affidavit of support under penalty of perjury saying they CURRENTLY reside in the USA with US income and an I-130 with residence history in the US does not need to provide evidence of a US domicile in any form.  Evidence of Citizenship or LPR status is only needed for a joint sponsor and/or household member, or a Petitioner currently living outside the US.

Ryan has advised you correctly, but the above from Abies needed correction.

Wow guys/gals thanks for the quick replies!

@Abies ok I will not include the Passport Pictures. I am bit confused on your comments for a "bonafide marriage". Do I need to include them in my NVC package? We will be taking chats, photos, phone call logs etc to the interview, do I need to put them into the NVC package? I have put in my latest PG&E bill and Home Mortgage statement for Domicile. Thank You!!!

 

@Ryan H Thank you for the reply. I will remove the petitioner documents. I am the sole sponsor. I will also remove the W-2, the only reason I included them was the transcripts I downloaded from the IRS website. I did place an order to get the "official transcripts", but the wait is 5-10 days. I don't want to lose any more time.  I also have electronic copies of my full tax returns filed, for all three years. I am just afraid that the downloaded version will not be sufficient. Has anyone had issues with the downloaded IRS Transcripts? I assume all the data is the same, maybe the letterhead may be different.

Do include the passport photos of the visa applicants.  They'll need more in hand for the medical and interview.

 

Your downloaded "Tax RETURN transcripts" are sufficient.  "Official" transcripts don't come on letterhead, but be sure they are the correct transcripts.

I have been reading carefully and trying to understand. However, this items confuses me because @Ryan H the petitioner (me) did not need "The NVC will not need the petitioner's passport bio page, the petitioner's birth certificate, or those other items you mentioned."

 

If you are applying for an IR5 visa as the parent of a U.S. citizen or for an F4 visa as the brother or sister of a U.S. citizen:  You must obtain an original birth certificate for your petitioner, or a certified copy.

Send a photocopy of your petitioner's birth certificate to NVC.
Bring the original petitioner’s birth certificate plus a photocopy to your visa interview at the U.S. Embassy or Consulate.


If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.
For country-specific guidelines on how to obtain acceptable birth certificates and marriage termination documents, use the Document Finder above.

 

Does this mean I need to include my divorce decree from the previous marriage? Do I need to put the same divorce decree in my stepson CR2 package?
