Hello all,

My situation is this:

Up until March 2007 I have been on an H1-B visa, and left my last employment at that time. Since then I have been out of status. I got married to a US citizen in December 2006, and I am in the process of compiling my AOS package.

Now, I understand that it's ok that I have been out of status for the last couple of months if I go ahead and file the AOS at this time. However, the Hep B vaccinations that are required need to be performed over 6 months time.

Is it ok to file the package without these vaccinations, and will I be placed in an acceptable hold status once I file? I don't want to exceed the 180 days threshold before even filing.

Any suggestions would be greatly appreciated!

You will need more than the vaccinations, you will need to do the medical also, you can visit a civil surgeon and they will do med and vaccination, you can then send in the medical and vaccinations that you have with the AOS paperwork.

You don't need to have completed the vaccination series before filing for AOS, just need to send in the medical and vaccination supplement showing that vaccinations have been started.

If married to a US citizen, an overstay will be forgiven when you file for AOS...

As for the Hep B vaccine, it is only required for people under the age of 19...

For people between the ages of 19 and 64 the following vaccines are required:

MMR

Tetanus

Varicella

you could also do the initial series at any doctor or the CS and Im thinking the varicella which is 2 shots and have the second shot when your supposed to and just take the record of completed the series to your interview with you, if you already send the AOS with the medical.

On saying that, some CS are known to be a bit weird so ask first whether or not your CS will allow just your records of shots being given but not yet completed to fill out the I-693A.

This post is meaningless if you have already had chickenpox. :star:
