K1 / Marriage & AOS Timing

Hi everyone,

I didn't see this in the guides. I am planning on getting married to my fiance near the end of the 90-day K1 visa period (with three or four days to spare). Is this too late? Are we going to miss some deadline for the AOS process?

The major deadline that you have is marrying within the 90 days. Your wife however will be "out of status" after her K-1 visa expires.

You just need to marry within the 90 days, you can go out of status with out problems, many have to do this because they are waiting for the marriage certificate, doing IRS returns, get to the civil surgeon to transfer vaccinations record to the supplement.

There is no dead line for filing AOS.

marrying her before the expiration of her I-94 and file your application for her AOS as soon as possible after getting married.

Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many newsgroup couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, newsgroup experience has shown this is not a major issue with local USCIS (INS) offices.

My husband I mailed out his AOS paperwork 2 days after we got married. We already have a biometrics appt for him. However, his K1 visa expires in June - although the visa in his passport shows it expires in September.

Is there anything we can carry with us if we're waiting for his green card and his visa expires? I've read he'll be out of status, yet not illegally here, right?

His I-94 expires in June... 90 days after his entry into the US. The K-1 visa with the sept date had to be used before sept... which you did in March so that visa becomes invalid after your one entry. Your husband is legally in the country and is in pending status. Never going out of status because his I-94 has not expired. If I think I will need to prove my status I carry with me my AOS NOA 1. This seems to work.
