Late filing of of documents

Good day everyone, i need help! ☹️

 

I entered US march 2017 as a B1/b2 visa , I got married january 2018, while i was waiting for my change of status to student visa,. I received a letter that my F1 visa denied. I expected that my paralegal filed my adjustment of status and 485, work permit and biometrics forms was already sent to uscis last mArch 2018, i was waiting for the receipt but i still didn’t get any. I called may paralegal August 2018 to follow up my case, but she lied. She haven’t filed yet. 😭 

do you think i will still be able to apply for my case?, and if yes.. am i going to get penalty? Cuz I’m already out of status. :(  

please help me.. thank you 🙏🏼

If your spouse is a US citizen, then you’re good. File for AOS ASAP. There will be no penalty and most likely, no questions asked. Don’t leave the country though,  or you will incur a ban. And fire your paralegal. You can easily fill all the forms needed by yourself. Just look up the guide on visajourney.

Thank you for your advise. Yes, my husband is a US citizen. My paralegal said i should wait for 2-4 weeks and then if I still didn’t received any yet. I will be the one to file it. I can fill out the forms. But I’m afraid cuz if i send my documents now, it might have double filing. :(

So did your paralegal send the documents in March, or in August? Or did they even send it al all?

1. Did she file in March or in August after you called her? If in March, it would be impossible that you would still not get your NOA. If You are sure she filled in August, wait till you get your NOA

2. Did you pay her the AOS fee or did you include a personal check specifically for USCIS instead? When or did it get cashed?

If you did not give her money for the application fees, fire her and file by yourself immediately.
