So ive met an americian guy who is a marine working in Australia and we have fallen in love. I want to move over to America. He goes back to america in October. He wants to propose and wants us to get married when I visit in December. What would be the process for me if I wanted to move over there to be with him ❤️❤️❤️❤️

If you get married while visiting in December you will then go back to Australia and wait while your cr1 (spousal visa) is processed. It takes about 12-16 months. You cannot come in December, marry, and expect to stay here. That would be Visa fraud.

Unfortunately, there is no quicker way. Shock of how long the visa process takes is the most common thing we see here. You are fortunate that you will be able to still visit during the process. There are many who can't even get a visitor visa to come over for a while.

No. So for you the steps are:

1. Get married while visiting. 

2. Go back to your country. 

3. Your husband file for cr1 Visa

4. You wait 12 to 14 months for approval. 

5. You can visit in the mean time but so not overstay.  

 

There is NO quick or easy way. 

Also him being in the military does not help in any way for your visa.

Nothing that would allow you to marry in December. The only thing that would get you in the US faster on a CR-1 would be to start the process sooner (get legally married in Australia now and file for a CR-1, have a ceremony when you're visiting him in December).

 

A fiancée visa would probably get you to the US faster (on average 9 to 11 months from application to visa in hand), especially since your fiancé could apply for it now rather than after you got married, but wouldn't be approved in time for a December wedding and has some significant downsides (you wouldn't be able to work or travel outside the US until 4-6 months entering the US with a K-1 visa, and the K-1 process is more expensive).

ASAP... hahaha.

 

It will take 12 to 14 months to the CR1 visa to process.

There is no such things as "best" documents..

Read the guides (here on VJ) and you'll know everything.

The process will involve 3 separate petitions... assuming that the 2 children are immigrating with you... IR1 for yourself and IR 2 for each of the children. 

Documentstion is clearly specified for each stage in the USCIS paperwork 

it will take 12 to 24 months from submission of the first documents for the  I 130, through the interview stage

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I’m an Australian with two kids 2 and 4, dating and americian who goes back to California in October. I’m visiting him in December for 2 weeks. We are thinking about getting married because we love each other. I eventually want to move over to California . What would be the process and when would I start it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

All depends on if you want to marry and then return to Australia and go through the CR-1 (spousal) visa process... or you could start the K-1 fiance visa process now technically instead of waiting..

 

CR-1 process can take 12-14 months... K-1 7-9 months about.... depends on your own personal choice.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

So I could start the K1 process now and still visit in December ?
