USCIS employees at California Service Center are the ones who toss up your papers to scan it. When they realize documentation is missing, you get an RFE.....same goes for inaccurate information.....it gets returned to you.

When immigration denies a packet like this,  they are allowed to keep the money

it is not clear with the new rules that they will but seeing that it costs them to return a packet, i would say anyone getting denied under new rules has lost the money remitted

This updated policy just ensures that all filers do the right thing and properly prove their case to USCIS instead of them telling you what you need. Their website already breaks it down to show what should be included, all of their forms comes with an accompanying instruction guide and yet, filers STILL come here to ask the very basic questions about what they need to do when the instruction guide already gave them the clear-cut answer.

maybe but when an application sent now sits on a desk for before entered into system anyone sending now should follow guidelines as your case may not be seen until sept 11th. do o u think a case sent today is worked on tomorrow or even next week?  september 11th is only 19 days from now

Agreed, which is why persons sending docs to USCIS should have tracked mailing to ensure the delivery date to USCIS regardless of when a worker decided to scan the docs into the system.

I called to ask and maybe the person didn't know the correct answer (i will give u that) but  i was told the offices are going by scan date

call and ask yourself and see what answer u get

ask for tier 2

You should amend the check and send the package back to them exactly as it was sent to you.  Do not rearrange it back to how it was, just leave it.  The cover letter is for OUR use, not theirs, in reality, so it doesn't matter if it came back to you at the front the back or not at all.  

 

Because you messed up just send it back with a new check.

YOU SHOULD SEND YOUR APPLICATION AT THAT ADDRESS WHICH IS MENTION ON THE GREEN LETTER WHICH YOU RECEIVE FROM USCIS AND YOU SHOULD PREPARE YOUR APPLICATION AS IT IS YOU DID IN FIRST TIME.YOU NO NEED TO WORRY ABOUT THERE SYSTEM AT LEAST THEY INVITE YOU TO APPLY AGAIN.OTHERWISE THEY ARE REFUSING NOWADAYS STRAIGHTWAY.

When I first submitted last year, mine was also rejected due to a silly mistake- the wrong version of the form! We got engaged in early 2016 and I downloaded a copy of the petition then. When I submitted in November 2017, it was out of date. I had a good cry since I felt dumb, and moved on.

 

When I submitted that first time, I had everything in a binder and in plastic cover sheets. First page was a table of contents broken down in to three sections with dividers: admin (petition and check), personal information (letters of intent, my birth certificate, picture of petitioner, picture of beneficiary), and evidence (pictures of us together with listed GPS, plane tickets, reciepts) and listed everything which page. It was a beautiful piece of work. When it all got returned, USCIS had stolen my plastic sheet covers, binder, and dividers and returned everything out of order. I think the table of contents was halfway through the stack! When I sent it back, i didn't make it as well put together. I just ordered it all back according to the table of contents and slapped it in the same envelope they had returned my failed petition in. I was pretty annoyed at the time and was very much in the mindset of not wanting to make it easy for them. Now, I wish I had since they sent me an RFE for information I had submitted to them originally that would have been easy to find if I had done the binder again. Maybe he'd be here already since it the RFE had a turn around time of nearly two months.

You shouldn't have sent a binder or plastic sheets.  The instructions specifically state not to send those items.

Thank you all for your replies. Some of you advised to send it as it is and others advised to re-arrange it. I've decided to re-arrange it and re-send it for a reason. Some of my flight itinerary (e.g. online flight ticket) that consist of 3-5 printed pages per flight were randomly misplaced in different places, which doesn't make sense to leave them like that because they need to be in order since the 3 pages complete each other to provide the detailed times of the flight. So just imagine how messy my packet was having 5 diff itineraries... etc. Hopefully everything goes smooth this time. Wish me luck!
