Ours was over a year (hence my timeline) and no my case wasn't easy because of previous denied entry at POE my now husband experienced while attempting to visit me in 2016 with his tourist visa. Filed May 2017 and he got here June 2018 and today makes exactly a month we've been married and just started our AOS 2 weeks ago.

 

So, when she's says I haven't experienced anything difficult or should experience something difficult....BEEN THERE DONE THAT!!!

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

did you read the link to another thread someone posted? The denial letter they got from USCIS seems extremely important to your case.

 

particulalry in your case I would think the following is important - note the first point.

 

“The approval of any petition is automatically terminated when the petitioner dies or files a written withdrawal of the petition before the beneficiary arrives in the United States".

"Because the withdrawal predated the approval of your I-129F petition you are subject to the withdrawal regulation 8 CFR 103.2(b)(6)."

"Withdrawal may not be retracted."

"Because a withdrawal may not be retracted and may not be refused, USCIS cannot adjudicate a petition that has been withdrawn".

 

Good luck with your case, when this thread gets closed I hope the mod doesn’t put in a “not to be referred to” so that you can come and update us in due course. 

Dont send me luck when you dont mean it and dont tell me what i dont understand. I am very aware of what I am up against.

Here is the thing, just because official rules state "Withdrawal cannot be withdrawn" etc, doesn't mean one should not try. It seems withdrawal hasn't been processed yet, so there is nothing else to do, other then to prepare for contingency by preparing 2nd 129F package and having it all ready to go. That package should also probably include the statement explaining the reason for original withdrawal request. In the mean time, I don't think there is a harm to try to do your darnest to stop withdrawal request from killing that 4 month old 129F. If it works, great, if it doesn't... Well you have a few months of a set back, and $535 in the hole, but that can be overcome.

i respectfully worry about the adjustment period of the person moving to the USA .... it is a much harder adjustment with much more stress than waiting by your mailbox for 4 months.

 

Even if you are truly in love the new customs, leaving family, new relationship is a hard process for anyone.  Maybe you should "date" long distance until you are 100% sure you don't want to call it off again because your fiancee wants ketchup instead of mustard on hot dogs..... 

 

I am so grateful my wife put up with the challenges and discomfort of the process....... we have always been 100% committed to each other and the process in spite of everything including a travel ban from her country.

 

I wish you luck and happiness with whatever you decide to do but deciding is the most important part!

You dont need to worry about his adjustment. We are good.. and you have no idea what caused what. Thank you very much.

Based on the posts of other members who have withdrawn in the middle of the visa process, it seems that it’s far easier to just go on with the entire visa process once you file the petition even if you start to change your mind. 

 

Obviously  this doesn’t apply to the Op’s situation as the withdrawal can’t be retracted, it just sadly shows us again that USCIS doesn’t take any withdrawal lightly. Perhaps USCIS presumes that they wasted time, money, and resources processing a file for nothing or that the relationship wasn’t bonafide 

 

I got into several arguments with my fiancée too during the 8.2 months wait for NOA2 but withdrawal was never a question
