Confusion over section of I-129F regarding I-94

Timeline

I am confused about the section highlighted (37-38h). It says if your beneficiary is currently in the US complete 38a-h. But on the instructions for that section it says provide the date of your beneficiary's MOST RECENT ENTRY. (I am the beneficiary and I am not in the US but have travelled there)

 

I can access and print my recent travel history and I-94 from the US CBP website. Should I print and send these as additional evidence? (it matches up with the photos and dates I visited my fiancee).

"If your beneficiary is currently in the US, complete item numbers 38a-38h." The beneficiary is not currently in the US, so you do not complete these questions. 

 

And yes, you can print your travel history and submit it as relationship evidence if you want. But that has nothing to do with these questions.

Ok thank you that helps! I know it says only complete those parts if the beneficiary is currently in the US but the instructions for the petition seemed less clear.

 

But that's good to know. I will print my travel record/I-94 as secondary evidence.

We sent Alec's I-94 along, and were approved at 185 days with no problems.  When I filed the petition, he had departed the US a couple of days earlier.

So did you fill out all of this section even though he wasn't in the US?

Nope.  We printed his I-94, and sent that. We left that section blank.

i know what you mean! a lot of the stuff is kind of contradictory or unclear. between the form and the instructions. so visa journey really helps

We were confused too because I-94 is also mentioned in the evidence section. For 37 we said yes and then 38a-h left blank. Called USCIS if we should include I-94 and the person wasn't sure. Basically said it's better to do it and it doesn't hurt anything. Also it's a proof of us visiting. So we printed and included I-94 and also copy of my passport page with picture and passport pages with stamps from the 2 last visits. We got approved after 187 days, no RFE

 

"Passport and Travel Document Numbers. If your beneficiary used a passport or travel document to travel to the United States, enter either the passport or travel document information in the appropriate space on the petition, even if the passport or travel document is currently expired."
