Guys,

 

I need advice for those who experienced filling a self petition only due to a divorce.

 

I filled my ROC May this year. And Im planning to file a divorce due to a lot of conflict in the marriage. 

 

What I need guys is for those who filled a self petition what is the process ? And Is there anyone here got re married while on a self petition? Did you use a lawyer? Hows the Interview., If u can share your experience please let me know., Thanks

You're not even divorced and are contemplating how to re-marry? 🤨

 

That being said, once you divorce there are no restrictions on getting married. However if you turn around, get married to someone abroad, and then sponsor their immigration, it will be heavily scrutinized. Otherwise, you are free to date/marry whoever you want.

 

Once you've filed for divorce and the divorce has been finalized, you will change your petition from a joint to self-petition ROC with a divorce waiver. You will need a divorce decree to get approval. Some states require a waiting period. In Texas, it requires at least 60 days and typically takes over six months. If divorce is right for your situation, sooner might be better.

You mentioned that you already filed your petition in May.....you will have to notify USCIS that your petition needs to change from joint to single due to divorce....but you are contemplating divorce and have not actually gotten divorced.

Hi, 

 

thank you so much for your reply., I havent started the divorce yet., Should I do that once the divorce is Final? Im hiring an immigration lawyer to handle the case after the divorce., should I let them call to tell them about  filling from joint to single? Thanks for your respinse,.

Yes. If you are getting an immigration attorney, then they will know how to handle your case from that point.
