Hello everyone,

 

So I entered the US on a k1 visa and we got married last week. I am now getting ready to file for AOS. I am getting very confused with this part of the process, it is very overwhelming. At my medical in London England I was missing a vaccination and got it done by my local doctor a few weeks prior to my flight here. What are the forms I need to send with my AOS packet? Is it just the I-485 and the afividat of support? Do I need to see a civil surgeon first to verify I have had the correct shots before I send the packet off? Also what is the timeline of the AOS as I would like to start working ASAP. I’ve seen people saying it can take 12 months, I was under the impression it would only take 90 days.

Why? Sending everything together is the best thing to do. 

 

There is no deadline on AOS. You can send it out whenever you want. Of course after 90 days you will be out of status if you don't file it though. 

 

Don't count on being able to work asap.  Once you send the whole packed (including ead form) it will be up to 6 months before you receive your work permit. Waiting time for green card is over a year. Someone lied to you when they told you the whole AOS will take 90 days. 

 

90 days is the time you have to get married and it's also the length of your legal stay. After 90 days when you don't file AOS you become sort of illegal. 

 

Also read the guides again. It really step by step explanation.

I only just found the guides. Thank god! I’m aware it’s best to send everything ASAP, but was wondering if it all needs to be sent together. Can I file for AOS and then for a work permit. Does it matter if I send for a work permit after the 90 days if I have already sent off my AOS

But why? The sooner you send out ead applocation form the sooner you'll get it. It's going to be 3 to 6 months wait just to be able to work and travel. 

 

You can send it after AOS but it's kind of pointless.

It’s because my partner is waiting on funds and will not be able to afford it all at once. It may be after the 90 mark when we send off for EAD. Just wanted to make sure this will still be ok.we have a baby due very soon so money is tight right now. But yes of course it makes sense to send it ASAP so I can get to work sooner I just want to know all possibilities

If you include all of it together then ead and ap forms are free... 

 

It's just one fee of 1200$ - ish.  Sorry don't remember the exact number. (Edit. Ok I checked. 1225$) 

 

And to be honest? This should have been researched way before your k1 arrival and you guys had enough time to put money aside on AOS.. especially since you won't be working for a while.

Ive just read it’s $490 this is what has thrown me way off. So it’s free 😂 of course we will file it at the same time then.

Thank you for clarifying this. I thought I was fully prepared and then when I read the fee on another forum I started to panic!

I can confirm that the EAD and AP fees are waived if they are filed for at the same time as AOS. File them at the same time and only pay $1225.

 

I agree that you should learn everything well before you start the process. The next step will after AOS is ROC in 2 years. Start learning about the ROC process and fees now.
