Timeline

I am going to file Advanced Parole for my wife and step daughter. They are currently on 2 years green cards which are expiring in Dec 5th, 2018.  ( I am going to apply for "Removing Conditions" in early next month).

They will be travelling on October 22nd, 2018 and coming back on April 3rd, 2019. 

I have attached the following documents:

  • I-131 application
  • Filing fee by check
  • 2 2*2 photos
  • Green card copy 
  • Driving license
  • Letter from her physician

 

Do I need to provide any other documents to file I -131  ?  I live in Denver, CO. Please kindly provide me some information.

They can travel in their extension letters after they file for ROC. 

 

I'd be more worried about pushing that 7 months stay abroad. 

 

They will be staying in abroad for 5 months and 10 days.

So what are you going to do if they will be called back for Biometrics while you're abroad? Is someone going to be checking your mail for biometrics invitation? You don't want to miss that.

Yes. I will be back in 2 weeks. So, I will be home for checking the mails. After filing for 'ROC', we will visit local office for extension stamp on their Indian passports. Please let me know if there is any other option.

They won't stamp their passports that soon.

They will receive extension letters after they file.

She is carrying a baby. Due to some health issues, our parents will not be able to visit us. So, she needs help from her parents before and after baby born.

Oh I see. She and your daughter both need to wait until they have the extension letters in their hands after filing RoC. They need the original actual letters before they can leave the US. They also need to wait until after their biometrics appointment. If they fail to appear to their biometrics, it'll result in a denial of their RoC applications.

I have heard that we can request for different dates / post pone for biometrics ? Is that true ? Please let me know.

If they get biometrics appointment by before October 22nd, we are good. Otherwise, we may need to request for different dates.

I don't know anything about rescheduling biometrics or any USCIS appointments because I've never done it. I think in the biometrics letter, they do have instructions for rescheduling. You would have to wait until you get the letter to see what it says. But I personally would not try to reschedule. I would just show up at the scheduled appointment to avoid any risk of something going wrong. You just never know with USCIS.

Thank you so much for all your information. My wife should not travel after October 26th (28 weeks by then) . So, I had to book the tickets 3 days before.

While you can ask for another appointment for biometrics, it is strongly advised that you not miss your appointment. I pulled our biometrics letter. It states, “IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION, PETITION, OR REQUEST WILL BE CONSIDERED ABANDONED.”  If you do request another appointment and the appointment is while your wife is away having the baby, what will you do then?  Are you willing to take this risk?

Rescheduling is super easy. When you get the form you put a checkmark or cross in the little box that says I want to reschedule. It's just not a smart move for the OP to reschedule as you probably can't postpone it multiple times.
