Current Status: Case received and pending.

On April 25, 2007, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you.

This is the info we have from USCIS via online case status. We still have not received a notice in the mail...Thank God someone posted on the VJ site the fact that the case number can be found on the back of the cashed check....THANK YOU!!!!!

We are new to this process and from what I read it can take a really looonnnngggg time for an LPR/K3 visa to get approved.....can anyone help shed some light on this for us....what is the average...

You can take a peek at my timeline in my signature. Luckily, my case is going to Vancouver which does tend to be quicker than Montreal. Right now I am waiting for package 3 to arrive- If all goes well- I estimate I will be back in the US within 2 months.

Your timelines indicates you filed for a K1 fiance visa.

If you filed for as a K3 as a Legal Permanent Resident, the petition falls into the second preference. You can view the visa bulletin to see the current processing status for this preference. It appears they are currently processing LPR spousal visas from April, 2002.

FAMILY-SPONSORED PREFERENCES

First : Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.

Second : Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers

I have been to that website and I find it very difficult to understand.....and I am hoping that it will not take us years to get to the US to be with with husband.......I have been told that the numbers are aloted according to the country you come from is this correct???

If I were you, I wouldn't assume Stacey33's petitioner was an LPR instead of a citizen. It would be real easy to miss that little detail in your post title. I hope it's good news but if Stacey33's petitioner is a US Citizen, the timeline is not applicable to you.

April 2002 is accurate for LPRs petitioning for spouses not from China, India, Mexico or Philippines. It's safe to assume that Stacy33's husband is a US Citizen and therefore his wife does not need to wait for a visa to become available.

Family = family-based petitions rather than employment based

2A = preference level

Second = The preference level Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents

A. Spouses and Children = the preference level specifically for Spouses and their children rather than unmarried sons and daughters of the LPR

All Chargebility Areas Except Those Listed08APR02 = currently processing LPR petitions for spouses NOT from China, India, Mexico or Philippines from April 8, 2002

It would be faster if you become a citizen and upgrade your petition if that is a viable option for you.
