Retaining Full Access to Place of Residence in US

Hi,

 

I'm wondering what kind of evidence one would submit (aside from mortgage, tax and insurance payments) to demonstrate that one "retained full access to your place of residence in the United States".

 

In our situation, we left the US so that I could work in China for a US-China joint venture. This was shortly after quitting a much higher paying job in Texas.  It was a big reduction in pay, but the company seemed to have a lot of potential, including an eventual US position. 

 

Before we left, we applied for and were issued I-327 Reentry Permits valid for up to two years, so that I could work in China for a planned period of about 18 months.  While we were gone, we rented our US house to a family on a 1 year lease, with the explicit understanding that we would be returning.    In fact, we ended up leaving China after only 9 months, to care for an elderly relative in Canada while I continued to work for the same company remotely on full pay. Our stay in Canada extended to 6 months, during which we allowed our tenants in Texas to stay on, on a monthly basis.  After 6 months in Canada (total of 364 days outside of the US), rather than return to our expensive house in Texas, that we rented a cheap place in Florida instead, immediately filed an AR-11, and sold our house in Texas after we got established in Florida. We now own a house in Florida and I still work remotely for the same Chinese employer. 

 

How do we demonstrate that we "retained access" to our residence if it was rented out during our absence?
