Making way over income but asked for RFE for same docs?

Hello friends. My husband and I are currently going through Adjustment of Status. We filed through a lawyer a month ago with all docs and I864EZ/ Affidavit of Support with 2017 tax returns and W2 and got a quick response and biometric interview a week later. Had my biometrics taken this past week. I received an RFE today regarding Affidavit of Support saying neither me nor my hubby can’t use the first I864EZ and now we gotta submit I864 with hubbys 2017 tax returns and W2’s again, the exact same documents we gave the first time. We think it’s strange coz hubby’s latest income is a bit more than the poverty guidelines. He was not making enough the two years before that, but they did not ask for those tax returns, only the most recent one. Other than that, they didn’t ask for anything else. I just wanna know if anyone has experienced this submitting income docs again even if you make enough or more..?

Hi, well they asked for regular form I-864, not a shorter version EZ. So just file what they asked for and send it back again with all the supporting docs. 

I never heard from anyone that you can use shorter version of I-864. Can not help with that...

What exactly was submitted originally?

For a W-2 employee, income is best documented via pay stubs and an employment letter. The tax returns are still required, but they show past income, not current income. What matters for the I-864 is current income.

If they said you need an I-864, then I would send that instead of the I-864EZ.

I make much more than the poverty guidelines, and included Tex returns to prove it the first time around, and then they sent me an RFE to provide bank statements and my taxes again, claiming I didn't make the support requirements. I've heard a lot of ppl had the same issues.

Initially it was I864EZ as given by our lawyer, along with copy of 2017 tax return and W2’s. The RFE now asks I864 and copies of the exact same documents we sent. Note that they only said “most recent” and did not ask for any pay stubs but just tax returns and W2’s and other docs we used when we filed our taxes. So the only thing changed is Form I864EZ to I864 and we are confused.

Could be that that version of the form had expired happen to my husband he had interview 3 days after a form expired and we needed to take the new form filled out with same info but the former expired gotta check the dates

Why did the attorney use form I-864EZ instead of I-864?  Is this common practice?  Has anyone here used this form?
