I will try my best to find a co sponsor but my hopes and dreams are when the embassy sees my I864 with all my supporting documents showing more than sufficient income they will be reasonable.

Called USCIS yesterday and found out both of those previous I130 petitions are dead in the water.  No financial obligations there thank God!

Would you happen to know if I am financially obligated to an ex husband if the I130 was approved but the application expired in NVC without filing AOS? My ex is not a LPR. He is out of status currently

If he is not a LPR, then no, you are not.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He is "off the hook" after your fiancé has 40 quarters of work credits (he can claim your work hours too) this can be done I'd say in 6 years if you BOTH work full time. Also off the hook after/if your fiancé chooses naturalization versus permanent residence. Naturalization process takes AT least 6 years for the interviews and waiting and more waiting of course for the 3 years being married requirement.

Why would they ask for a co sponsor if you didnt need one?

That ... is a circular argument? Jenny now needs one because Embassy asked of them to have one. I believe the point Jenny tried to make, that their income satisfied 125% poverty level requirement (I think it is actually 100% for purposes of K-1, and 125% for Adjustment of Status)

You can see it here "MY W2 from last year was over the threshold from my main full time job and my income this year is even greater as I get annual increases in my salary.  AND I have a second job as well!"

 

Why did request one in a first place? We can speculate but never know for sure. As frustrating as it might be, it seems the most practical way is to try to find one (I hope Jenny's search went well btw! Don't think we saw an update) then to try to fight bureaucracy of "I shouldn't be needing one in a first place based on your published requirements!"

Timeline

So we had our second interview at the embassy today. I was able to secure a co sponsor in time and our visa was approved.  We will pick it up at the embassy on Thursday and my fiance will fly home with me Saturday.  The CO did address my questions regarding the co sponsor by simply saying even though I met the income requirements it is still at the embassy's discretion to require a co sponsor.  End of story
