No you are right policy will be effected  from 11 sept. 

It was my first time. And i didnt knew.  Now i know how to deal with immigration and uscis. And dont worry anyone have problem. They can ask me i will be happy to help  as much as i can :)

.. We decided to just submit 1 letter with both of us signing the letter because It did not say in the guidelines that you actually need to submit 2 letters.. And i believed i have read here before we submitted our packet that some vjers have submitted only 1 letter for both of them... Of course with the words "we"... 😣😣😣

What do you mean they don’t submit rfes for cases submitted sep 11 onwards?

Hi Faisal,

 

Need a little advise, last Friday lockbox cashed out our check but until now, Wednesday we haven’t receive any notification by email/sms nor mailbox for NOA1. And actually we were submitted our petition since 17/8. Do you think it’s ok for us to call them again or should we give some more days this week? Thanks

Hi there... Just to correct you.. Its not "they dont submit"... Its "they wont issue"... Anyway... There was a new policy that released sometime in July i think... 

Where it says... Uscis will not issue RFE anymore... Effective from case submitted from sep11 2018... Which means you have to do it right on your first submission... They will just reject your submission if there is missing documents or wrong information.. They wont give you chance to correct it... But of course we don't really know to what extent... So maybe need to study more if you want to know more  about this.. That's why me and fiance tried to submit it before sep11.. We never know cause no matter how we think that we did it all correct and complete but we still can miss something...

This friday morning or evening you will hear from them and give them atleast two weeks after cashout. If you didnt hear anything in next week then give them call

Thank you , I submitted my paperwork in August so thankfully this doesn’t have affect on me, but it’s good info to know for future purposes

I got a hold of the memo and read over it and there is so much in there to explain but it has nothing to do with K-1's. Basically if you are applying for a benefit (visa) and you are not eligible for that benefit or you are not using the benefit for its intended purpose then the adjudicator doesn't have to send you a RFE or a NOID. Just VOID. Done!

 

But if an application is received with an error or missing documentation and is the intended benefit then the adjudicator is obligated to complete the entire processing up to and not including the approval, but must combine all RFE's for that case into one request. If the adjudicator determines that the application is a "place setter" application, meaning they don't have all their information at the time of filling but hey USCIS will send an RFE and then I can respond with my missing documentation that I now have.  In the past they may send out a RFE letter then two weeks later send another RFE for a totally different circumstance tied to the original submission. The memo requires them to ask for everything in one letter.

 

So there are many good things in the memo. One just has to take the time to read for themselves and not rely on CNN or Betty Lou over in the Jamaican thread who is afraid that the sky is falling in on her K-1 visa with the intent that she is going to get denied.

 

Believe it or not the spirit of this letter was promulgated in the Obama Administration. This administration is only trying to get the rules so that they are followed. There isn't anything in there that is made up without a reason now or from the past.

 

This does not effect anyone applying for a K-1 visa. Carryon.

One letter is fine as long as the two of you signed it.

I got legal advise on this & she said as long as both the petitioner & beneficiary sign & date the letter, it's okay.  You will need a an updated one once your beneficiary is ready for the interview stage.

Not all Embassy's require an updated letter. I recommend everyone read their Embassy's P3 letter as it will have all the requirements for the interview. No need to do when do will do. :thumbs:
