Preference Categories

When petitioning for your relative, the following preference categories apply:

  • First preference: Unmarried, adult sons and daughters of U.S. citizens. (Adult means 21 or older)
  • Second Preference (2A): Spouses of green card holders, unmarried children (under 21) of permanent residents
  • Second Preference (2B):  Unmarried adult sons and daughters of permanent residents

Hi everyone, I could use some advice. I went to drop off paperwork for my RFE today to my attorneys office. I told the paralegal about my fiancé visiting from March 30-April 6. She told me they may not let him in through customs when they see we’ve applied for the K1 visa. So I started sobbing in my car because we want to visit each other. I left a voicemail for the customs office he would go through asking about him visiting on the K1 visa so waiting for them to call back. What are the chances he’d be turned away? We’re doing this legally but it would break my heart knowing he’d be half a mile from me and then turned away.

There's a post in the main forum titled Yes, you can visit where you may find answers to this question. From what I've read, your fiance can visit.

My attorney called me back and said he would charge me $50 just to write an affidavit saying he’s only visiting for a week and he said even that won’t guarantee anything. What the heck! He is making it sound like he will be turned away at customs

I'm getting mad just reading this about your attorney. Anything to get money. For one you can write your own affidavit and have it notarized for nothing. But that isn't necessary. 100s of people visit their fiancés on tourist visas while k1 is pending. With tourist visas I'm pretty sure you have a return ticket. You'll be fine as long as you have any proof you're leaving the country and not violating the visa (i.e. getting married). The lawyer is simply confusing the process  of applying for tourist visa after you've already applied for K1 visa. Doing that is very difficult and regularly gets denied. However already having a tourist visa is a different story. As long as you don't violate the visa and over stay or get married then you will be fine.

IMO, save your 50 bucks. Yes, there's a chance he may be turned away, but hes coming with round trip tix. he needs to demonstrate he got ties to his country 5hat cannot just be left in the air.  I didn't read that entire thread, bit I did not come across someone being turned away.

I am with my fiancé right now in the states since feb 16 and I even took 3 suitcases full of stuff that I have to move (didn’t even  have clothes in my suitcases). They do have a new form I got for the first time. you have to fill out in the plane where they ask about any immigrant or non immigrant visas you applied for, when you did this and if it got denied or approved so I have no idea if they have new rules about crossing the border while waiting for a visa like this.

Does he need a tourist visa? He’s only staying a week. I think the tourist visa is if you intend on staying longer than 6 months?

I assumed since hes visiting he already had a tourist visa. Sorry I replied without seeing what country hes coming from. I don't see why he would be denied entry if he is approved for his ESTA. And also can show he is staying less than 90 days.

He’s from England. If he’s applied for an ESTA once does that mean it’s good for every visit? I remember him saying he had to buy a visa to visit and it was like $15 or something
