That is even better!!!! Im waiting in the RFE letter to find out what they need. I sent sooooo much information. I called and while the lady claims she doesn't have access to the information of what they are asking for she said don't panic it's usually something silly ....I'm hoping that was her giving me a hint😂

Hahaha I can imagine. Most RFE’s aren’t really hard to fix. Hopefully it doesn’t take too much time but keep in mind.....the longest wait is over!

First off I would like to thank Greenbaum for all of the help and information  provided for all of us going through this process.  It is much appreciated.  

 

I do have income questions again though.  My fiance works only part time and was off work most of last year due to an injury.  This job he is at now is new. He never collected disability or any government income while off work because he has money in savings to live off of.  He has a house (with a mortgage) and money in savings.  It is at least triple plus the minimum income requirements.  Does anyone know if savings is enough to show he can support me?   He also has a financial settlement coming soon. Thanks in advance. I will be going to the Consulate in Montreal for my interview.

To figure if you have minimum income requirements where upon you fall short of the need match then the difference times five is what he'll need in savings.

 

Example..   His W2 wages are 19,275 ($1000 short of the guideline), then you need $5000  ($1000 x 5) in bank deposits to make up the difference. If he is $2,000 short then he will need $10,000. So it goes up very quickly.

 

If you PM me with his different incomes that he his or will be receiving, maybe we can figure something out. I wouldn't want to talk here in this thread about personal income matters. Of course if you are satisfied with my answer here then there is no need to take this further. Up to you. :thumbs:

There is no hint. She really doesn't know. She has no access to that information other than being able to let you know that their is a RFE in the making. Yes most RFE's are of the minor issue.

 

Technically speaking, an RFE is a written request for more information and documentation that USCIS mails out if they believe that they don’t yet have enough evidence to approve or deny a given application.


There are many varying degrees of RFE's. Some as simple as not "ticking" off a question. Others forgot the fiancé(e) letter and then others who met on a website and now need to prove that it wasn't a marriage arrangement website.

 

Once you get your RFE, read over very carefully as you only have one chance to reply accurately without causing undue harm. Once you know what it is set out to correct and to include "everything" they are asking for. Then reread the RFE to ensure you are compliant. Make copies of everything for your record and send back using their instructions which are contained within the RFE. If the RFE requires a signature, PLEASE don't forget this. Once received at USCIS your case will begin adjudication where the agent had left off. No one can tell you how long it will take so be patient.

Don't believe that. I'm a beneficiary and I entered the US via Austin around a month ago. They didn't even ask about my pending application. CBP themselves have stated on their website that you can enter the US with a k-1 pending, they're just likely to take a closer look at you, and even then they often don't. The beneficiary just needs to bring undeniable proof of their intention to return back to their home country. Such as a statement from their place of work, an active ongoing rental agreement, bills etc. Stuff that proves an ongoing life in their home country and that would prove to be detrimental to their lives if they abandoned it anytime soon.

Wow that's crazy.  I've gone to see him since filing and also to visit other friends and family in michigan and havent had issues yet but they have been short visits.  I didn't know how extended visits would be looked upon.   I wonder if it depends on the crossing
