He said that he told them that he had been arrested for DUI but was fined for less than $500.. However, he didn't think that he "ticked" the "yes" or "no" part. So I advised him that he was indeed giving conflicting answers. He said that he don't think there will still be records of it.. Any advise on how best to proceed?

I would have him call the courts to find out if there are records and if so get a copy.

Hello guys, did anybody know if there is some problem when you get the paper NOA2 but both site still say "case received"? I wonder if that can cause delay in the transmission to the NVC?

The sites are not reliable as they aren’t regularly updated or in some cases aren’t at all. Received my NOA2 in December and the old site still says case received. It’s nothing to worry about and will not cause any delay. The paper notice is what you want to see.

No sites were updated for me either but the case now is at embassy. There was no delay. Right now it seems to take 2-3 weeks to transfer case from USCIS to NVC.

I just called the NVC and they haven't received my case yet after two weeks. I guess I shouldn't panic yet since it hasn't been 4 full weeks like the NOA2 says.

Here is a similar issue that I will use as an example. John has posted about his ordeal and it is worth the two of you reading BEFORE you send your RFE back.

I failed to mention a 30 year old misdemeanor arrest that was dropped and later expunged.  It was my fault and partially the fault of the company we used to help with the petition.  The governments instructions were very clear.  The company we used was not as clear as they should have been.  Since there are no public records and no possibility of me getting any information, I assumed it was no longer an impediment.  The expungement ordered all records, digital and hard, to be destroyed.  There was no record that I could produce so I failed to add it to the petition.  That was my mistake and we were denied because of the petitioner failing to disclose information in the petition.
