Pending I-751 and N400 - Wife studying abroad?

Hello,

 

I currently have a pending ROC and pending N400 both of which aren’t likely to be adjudicated until later this year/early next year (filed in April 2017 and April 2018).  My wife has applied for and been accepted to the University of Edinburgh, Scotland to do a masters program. It is a one year program and she intends to move there for the year, flying back to the US every couple of months to see me and then me flying back to the U.K. to see her in between that when work allows. She is yet to decide if she is actually going to go or not but my question to you all is how is this situation going to affect my immigration applications?  She has already said she will fly home for any interview required but my concern is how this may look during interview. We have been happily married for almost 4 years now and have plenty of evidence of a joint partnership. I’ll be continuining to pay our joint bills and send her money while she is in Scotland to.  I don’t want to deprive my wife of this opportunity but equally I don’t want to cause issues for myself either. Any advice would be appreciated!

When does the program start? My wife filed for ROC in April 2017 and N400 in April 2018. She just had her combo interview yesterday and had both applications approved. You might be closer to an interview than you think. Nevertheless, I'm thinking you won't have a problem since she would be maintaining domicile in the US, with you. Maybe others differ with that view.

Thanks for getting back to me quickly. My wife would need to leave in about 3 weeks time. I haven’t received an interview notice at this point and truthfully have no idea how long it’ll be for me because the wait times in Los Angeles are very long. I was hoping my ROC would be approved before citizenship but apparently they are combining them now, even though I’ve had no update like others had to say cases transferred to NBC. Congratulations by the way!

I don't see any problem if she accepts and goes to Scotland - you will have completely reasonable explanation why you , guys,  are in different countries. 

 

Just probably keep track of your trips and collect proofs of your visits.
