affidavit of support if teh petitioner U. S citizen live abroad

Timeline

Hello everyone, My husband is U. S citizen and we live in Uruguay . we are currently waiting for i -130 get approved, but we dont knoe exactly how it works regards affidavit of support if he dont have no income from U. S. Anyone in the same case??? His brother can be my sponsor?? How this work?? Thanks

Your husband needs to be your primary sponsor, no matter what. The brother might be a co-sponsor at the most.

Your husband needs US domicile.

 

Of course, he needs to show that he filed US taxes also - he needs to do that no matter where he live. If he didn't, it's time to file them NOW.

 

Please search the forum, those questions have been asked a lot.

  1. He must present an I-864 as the petitioner even if he doesn't have any qualifying income. Qualifying income would be income that will continue from the same source upon return to the US.
    1. Note that this means he must have filed US federal taxes for at least the past 3 years (USCs are taxed on worldwide income). If he did not have income above the minimum threshold for a year, a signed letter can be provided stating why he was not required to file.
  2. He must show US domicile or sufficient intent to establish US domicile before the visa can be issued.
  3. He can use assets instead of income, at 3x the required level for a spouse.
  4. If he doesn't meet the financial requirements, he can utilize a joint sponsor. A qualifying  joint sponsor would be any USC or LPR (green card holder) domiciled in the US who meets the financial requirements.
    1. They would submit their own I-864 + supporting documentation (i.e. tax return(s), pay stubs, employment letter, etc.).

Thanks, the thing is he have be en living abroad for the last 10 years and he never knew about pay taxes if you are out side u. S for so long. Now we want to restablish i U. S. 

Do you know how that can be fixed?

Start by filing backed taxes. He probably won't owe anything with the FEIE and/or Foreign Tax Credit exemptions.

Seek a CPA if necessary.

Yes, he will need to fix his taxes. That's something that you'll need for your visa interview.

I assume he worked overseas.

Yes he was playing basketball overseas but now he want to get retired. And the domicilie we dont have it yet. So he must proof his carreer here is done or what?

Since you are abroad,the consular officer might require your tax transcripts for the 3most recent years because as a USC,you are expected to file taxes yearly irrespective of wherever you reside.

ok, but i need to show that in the consular interview or send it to NVC attached to the affidavit of support??

And if i pay taxes in the country im living now, i should declare it anyway? thanks
