Hi Grazy!

 

So yes, I lived in China for a year and a half and had to obtain Police Clearance Certificate. I am not going to tell you it was an easy thing to obtain, but any case is different depending on the city you were living in. I had a student visa that I turned into a residence permit and kept all the documents (police registration slips and enrollment papers from the university). You have two options:

 

1. Go to the PSB where you had your residence registry at and ask for it in person;

2. Hire a lawyer and let him take care of what can turn into a giant mess.

 

If you lived in China I am sure you are familiar with the bureaucracy and the rules vary and changing from person to person.

I lived in Kunming (Yunnan) and apparently is one of the most difficult to get the CNCC (Certificate of No Criminal Records) so I hired a lawyer who was great in assisting me in this matter. I could not personally fly to China because of work reason so I had to send him:

-Original passport

-Fingerprinting Card (Notarized and authenticated from the Chinese embassy in Italy)

-Original residence registration slips

-Power of Attorney (also notarized and legalized authenticated from the embassy)

 

A lot depends from the city you make the request too, some are much easier to get. Also like in my case they refused to cover the first 5 weeks simply because I had the student Visa in that time and the residence permit takes a few weeks to be issued. The lawyer provide a full documentation, translation and notarization explaining all of this addressing directly to the US consulate in Naples.

Before hiring the lawyer I inquired to two law firms that specialize in this matters and the rates were he same. All in all it costed me USD 1200 and took me 3 months, I am just in these days waiting for the original documents to be shipped. It might be much easier for you tough, if you lived in Beijing or Shanghai or Guanzhou. Let me know if I can help you with any other information!

Thanks for your response, i lived in jiangsu province and i lived and worked for 4 different cities, my case is really complicated and it makes me so frustrated.. but do you know some agencies that is reliable ?

I am not sure how it works with different cities as I imagine you had to register at the PSB anytime you moved around. Personally I hired Chodorow Law Offices since they seemed very reliable being based both in the US and in China and they specialize in immigration matters. Try getting in touch with them, they are very responsive and helped me in anyway they could -even called the embassy here in Italy multiple times on my behalf since I could not get any infos from them-.

 

Don't get frustrated, I know the feeling especially with dealing with massive bureaucracy issues, take it one step at a time! You will manage to get this for sure :)

 

And if you can't obtain it the lawyer will certify the reasons you cannot obtain a CNCC. Since mine was unobtainable for the first five weeks, the lawyer collected all the proofs that we had and filed a detailed 35 pages report: (maybe also a little too much :D)

 

"According to the US State Department Police Certificate can be waived under two circumstances:

 

First, “In the event that the immigrant establishes to the satisfaction of the consular officer that” a police certificate “is unobtainable, the consular officer may permit the immigrant to submit … other satisfactory evidence of the fact to which such document or record would, if obtainable, pertain.” 9 FAM 504.4-4(F) (emphasis added). Second, even without proof the certificate is unobtainable, if the Applicant “has presented a comprehensive police certificate” from their “country of principal residence,” then a consular officer need not require a police certificate from a “former residence,” provided the Applicant presents other satisfactory evidence of good conduct. “For example, it has been held that proof of membership in or affiliation with a reputable religious organization in a religious capacity during periods of foreign residence may be accepted as such evidence.” 9 FAM 504.4-4(B) (emphasis added)."

Done my interview last tues but under 221g coz need to submit the police clearance from china, im already searching some agency could do help me and theres one who could get PC for me for 4 cities but its too expensive 😭.. im wondering if could get only the last city ive been at? Much cheaper isnt it?

Sis why it’s difficult for you to get Police Clearance ? Weren’t you aware you need to get one when you were just filing your I-129F?

You need to get one if you lived there more than 6mos. Unless, in the whole china they only issue one. Do they issue PC each Province?

I dont know sis some says i need to get pc every province ive been at..

Yes but were searching how to get one without doing it online, and thought usem will consider me having not a PC since its really hard to get one coz when i went to chinese embassy they told me to go back in china if i wanted to obtain a PC 😢😢

The only thing you can do if you want to obtain one without going back to China is to hire a lawyer. The PSB will not issue that to any friends or family. You need to give the Power of Attorney to a lawyer making the request on your behalf. Try contact the Law Offices I told you in the previous post, explain your situation and ask if they can help.

You lived in China but as of what I understood the local offices from the different cities you lived in will cover the period of your residence permit in that specific city. Very different from the Italian one, for example, where the certificate states that I didn't commit any crime on Italian territory. Again that's how I understood it but I might be wrong. It's really a pain to get it done so I advise you start inquiring soon! Did they give you a deadline for presenting the police certificate after the interview?

Yeah in their email sent to me it says about 1 year if no action after a year it will be forfeited..

 The last posting in this thread mentions a Chinese lawyer services purporting to be able to obtain Police Clearance Certificates all over China. I have not seen any reports about the service. It is likely a service where you will need to get out your checkbook.
