Hey! So I have some very specific questions about the processes I'll have to go through upon arrival in the U.S.

It's been confusing to try to find an answer to those online so I'm counting on this community to point me in the right direction 😊

 

So my plan is to arrive in Texas on my K1 and stay there for the first 3 weeks, during which we will get married and then promptly move to CO permanently, which is where my fiance currently lives and works.

That said, my questions are:

 

1. If I apply for my SSN in a TX office before marriage, can the card be delivered by mail to a CO address?

 

2. I saw a lot of people saying they had to go back to the SSN office after marriage to change their name to their married names. I am not taking my fiance's last name after marriage as this is not a thing we do in my family. So in this case, I wouldn't need to go back to the office for that change and can keep using the SSN as is. Correct?

 

3. In Texas, is the signed marriage license returned to the County Clerk by the couple or the person who performed the marriage? Is this done in person or by mail?

 

4. Is my Brazilian driver's license valid in the U.S after arrival on a K1 visa? For how long?

 

5. At what point should I apply for a drivers license in CO? Does my I-94 still have to be valid? Do I have to wait for EAD/greencard?

~~moved to moving here and your new life from K1 process and procedures. While some of the questions are K1 based, majority are about getting married, SSN, and driver's licenses~~

 

1. Probably, not sure

2. Yes you can but after you get the green card you will probably want to get the "valid with authorized work permit only" removed from the card after you get the green card

3. not sure

4. Probably not

5. In Colorado there are two types of driver's licenses.  One is for people who do not have LPR status and one is for those that do.  You can wait for your EAD and apply for the normal one or apply for the other so you can drive before the EAD

#3.  Either for both.  The person who performs the marriage or you can mail it back to the county.  It also can be hand delivered by either party.  For us, we hand delivered back to the courthouse so we could get a certified copy right away.  They gave us a certified copy right then.  Given the numerous counties in Texas, your level of service may vary.

#4.  A foreign license is only good for 90 days in Texas and Colorado before you need a Texas or Colorado license.

1- probably. But if you got early enough you should get the card within a week, so it’s still doable to get it in tx

2- if you’re not changing your name, no need to go back to the ssa office. I suggest a you go back when you get the green card

3- I think both can be done. Call the county you’re getting married in to get more info.

4- it should only be good for a month or so. Don’t go for the pid (I think that’s the name for it, it’s basically a translation that won’t be of any use). Since you’re not coming in a tourist status, you can’t rely on your Brazilian license

5- start researching this as soon as possible. If you can’t get a license right away you’ll need to wait for was and that’s going to be a huge setback

Thanks everyone for taking the time to reply! It does look like the only complicated thing amongst the ones mentioned is the driver's license, so I'll make sure I research well before my visa is granted. 😊

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

" Have you tried the search tool? K1 isnt an easy process and a LOT of reading is required to avoid problems (RFEs) etc, if you dont like reading, be prepared to spend WAY more time and couple more $$$ with an lawyer "
