Are you the beneficiary or the US petitioner?

 

The beneficiary can process from any country they have legal residence/status in such as a work visa. 

 

If they do not have legal status in say Country B, then yes they need to return to their country of origin where they are a citizen.

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Again, the US petitioner can petition from anywhere. 

 

The beneficiary must have a legal status in the country they want to process through.

 

So for instance, say you're from the Philippines but residing in Japan right now... well if you're in Japan legally on a work visa or some others like it, you could process through the embassy in Japan... now you have to still get certain documents from your home country; but that can be done from abroad usually.

 

If you're in Japan though and out of legal status or, on say a tourist visa, you can't and would have to go back to the Philippines to process.

What is your citizenship?

 

What country are you in right now and what is your legal status there?

 

What is the reason that your lawyer is telling you that you must go back to your country of origin?  

 

We need answers to these questions to guide you properly.

He didn't say it he was just saying i should go back to the country of my origin..he said he would send all the papers there so i should go back,so for me it dosent make sense why i need to go back and process there while im overseas and i not staying in my country.so please giys help us what to do thank you:-)

Im from the Philippines.
