You also need to remember by the time they get around to calling you for an interview your husband could already be done with taxes.

And they would consider the new financial information? I thought the I 864 was what was legally binding and therefore the basis of their decision?

If for some reason they want more income (they shouldn't) they will ask and that will be when you hand them new information with an updated I 864.

Bring updated I-864 to interview. So no benefit in waiting to file.

Is this what everyone does or is this just an option? Because if I can just bring an updated 864 to the interview then I’ll file tomorrow..

Yes anyone that needs to make changes has been given the chance to do this.

Awesome, thank you! Well in that case there is no benefit to me waiting to file if I can just bring an updated affidavit during the interview. Had no idea that was a possibility I thought it was a one and done. Changes everything.

Yes and the interview notice that everyone receives states to bring any updated/new documents (financial and otherwise) that prove the ongoing marital relationship since the time of filing. It takes so long to adjudicate that USCIS knows life continues and therefore would like to see documentation of it.

Your attitude is exactly why a lot of Americans don't like foreigners - legal or not. If you can't go by the rules, head north. Waiting on some taxable income figures to bolster your case is meaningless to your situation. One good year doesn't make much of a pattern. And your numbers can (and might) go down. I've owned businesses - nothing is certain. My advice: Get a better attitude.

Zero pro in waiting.

Still no pro in waiting and most states have similar rules/limits on how long residents have to switch to a local licence and police officers have their own interpretation (not necessarily correct) of what is allowed.

If you live less than 100 miles from the border, the ocean, or an international airport, you can also encounter a checkpoint.  Used to be in Southern states, but we have seen them more and more in some very quiet areas of New England.  Being detained, even if only for a few minutes, is not a fun experience - why risk it?

Best of luck - I have nothing to gain, or lose, with your decision - but really feel it's better for you and your family to have a clear legal status asap.
