Hi everyone :)

 

I hope you're all doing great!

 

I have a question regarding the birth certificate to be submitted at the NVC Stage (CR1 visa for spouse beneficiary) and at the US Paris Embassy for my interview.

I am a french national but born abroad. Can I just submit a "Copie Integrale de l’Acte de Naissance" ?

 

I am reading this information at the very bottom of the page http://www.visajourney.com/consulates/index.php?ctry=France&cty=Paris&entry=31"

 

*If you were born in a country besides France and are a French citizen, you need to have both your birth country's birth certificate AND a recent French issued birth certificate too.

 

 

 

I have my old birth certificate from my birth country that I can get translated in English but it looks very "old school" and is not in the best shape. I also had a first name change that is reflected on my "Copie Integrale de l’Acte de Naissance" so the two documents won't even match...I also can't ask for a new one in my home country as I never lived there, have an ID or passport from that country...I was just born there.

 

 

So for people who have been through the same scenario, is it enough for me to just provide a "Copie Integrale de l’Acte de Naissance" ? I know it's a rather specific question...

Two thoughts:

 

A) I don’t see those instructions on the embassy page, and frankly they seem a bit onerous, because ... 

 

B) I’m wondering whether the instructions on the visajourney page are originally intended for those born abroad and who were then *naturalised* at some point. I mention it because, for example, my husband was born in Colombia, but he’s not Colombian, and his French birth certificate clearly lists his French parents. I don’t have any idea about how he could even go about asking for a Colombian birth certificate. 

 

C) In french law the état civil is sufficient, so I don’t know why they’d require a different country’s birth certificate of which you aren’t even a citizen. 

 

That being said, we haven’t gone through the interview process. Those specific instructions aren’t on the embassy’s site, so I’m left wondering what the source of the visajourney post is.

Get the "birth certificate" translated, and provide the French document as well.  The birth certificate is a required document in all immigrant visa cases.  The French document you mention serves to track your name change, for starters.

 

With regard to name changes, we see this most often with divorced women.  If their divorce decree does not mention their maiden or other former name, a "Marriage Certificate" for former marriages is also needed, to show that the Mary Smith on the birth certificate is the same person who married and divorced Mr. Jones, and then married Mr. Thomas.   Otherwise, how are they to know that the divorce decree for Mary Jones is for the same person as Mary Thomas or Mary Smith?

Facts are cheap...knowing how to use them is precious...
