Does the child have a US citizen parent?

 

If so... they don't need a visa. There is a different process.

"He" ? Your petitioner is not US citizen? Then you don't even qualify for K1 or K2 visa.

 

Otherwise. Please answer my question... if the child have a US citizen parent, then the child don't need a visa to the US. I don't know much about it, but please check the link I've send.

?? Why not? She cannot get K2 when she's US citizen by birth. Did the father have US citizenship when you applied for K1 visa?

The child is a U.S citizen already and you can not apply for her so let the father apply for her because you said the father is a U.S citizen but not you.

What is the reason a CRBA was refused?

If the child may be a USC, the CO cannot issue a visa until they verify if they are a USC or not.

Maybe I am misunderstanding, not sure. Your child cannot travel with CRBA by itself but, if child has a CRBA, he/she can then apply for a US passport, Social Security card, etc...

There are instances when the child would not qualify for the CRBA.

I'm not sure the k2 is applicable though or if the child needs an I-130.
