Sounds odd but can GC holder reapply again to set things right ?

Hi to all VJ followers,i got my green card two yrs  ago through a marriage waiver after getting divorce .but my ROC application got a mistake that may affect the good moral character to apply for citizenship  nowmy father is GC holder and apply for his naturalization ,how can i reapply for green card through my father? Plus if i have children and spouse  oversease can i include them in the new petetion.?how long this suppose to take and how to do it? Plz help i don want to go on with lies and proofs.this is not my decent self thx .

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

1. Did your ROC get denied?

2. What mistake was it in the application? Was it with the paperwork, or something else?

3. What are the 'lies and proofs'?

4. I don't think that this is possible, but I think it's even less likely that you can sponsor your wife and kids.

Whatever is in your ROC application, it is in your file now, and USCIS will find it with any new application you may send in. A different application doesn't make you a different person.

So.. you made some BIG lie on your Roc application and now you're afraid the truth is going to come out? That's why you want a new green card through your father?

 

Well. No. If you lied then you gotta live with the consequences even if it means deportation. 

 

EVEN if you'd officially abandon your green card now and apply for new green card though your father then whatever lied you made on ROC application is still going to be there.. USCIS can still check your applications in their system. 

 

You can apply for the foreign spouse now but if you lied in your previous paperwork..  I would not apply. Because this will make USCIS look harder at your immigration history.

Op, your paperwork is on file, it is not going to change.  You could absolutely rescind your greencard, go back to your home country, and have your dad apply for you once he is a citizen (and include your wife and kids), if you are legally married).  But whatever issue cause you difficulties with ROC will still be an issue, so basically you are just paying more money.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Apart from all the stuff still being on file....

... surely the only way to reapply through soon-to-be usc father is give up green card, leave USA, have father file, and wait the 13+ years it will take for a married child of usc to get an F3 immigrant visa. Then see if whatever is on your file will prevent you getting that green card or if it will be ok....

Poster has many previous posts from the time of his roc on VJ, I couldn’t read them all, someone else may have the energy to read more and get a fuller picture, on my brief read it seems to be a combination of his blaming his wife for not acting like a woman /being abusive towards him and some issues about him only briefly being in the us before the divorce, inability to show financial comingling etc & consequent concerns about validity of marriage.

 

one does wonder how the timeline of ROC just two years ago fits in with the spouse and children overseas....

I’m I reading right? You got divorced but have spouse and children overseas all at the same time?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I think I know where the lie is: Two marriages were ongoing at the same time here. The second was entered to get a GC, divorce then bring the first spouse and kids to America. However, seems the individual found out that they will never petition for the first spouse with this GC as USCIS will know (The individual had to lie on the initial petition that they were “Single” but has later found out this was the end of any petition for the first spouse).

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
