Cairo, Egypt - Military Conscription + Travel to US

Hey everyone,

 

My husband finally received his passport with his US visa inside - hooray!!! It took about a year and two months from start to finish...not bad considering our current government.

 

Anyway, my question is this:

My husband is not yet 30 and has not yet completed his military service - he's continued his studies and hasn't been required to do his service yet. Now that we are ready to move to the States, we are wondering if we need any sort of stamp or paperwork from the Egyptian military stating that he is allowed to travel? Or will an enrollment certificate from his university be sufficient?

 

Also, because he's not yet 30, would we be able to travel back to Egypt without fear of him being conscripted before a) he turns 30 or b) he becomes a US citizen?

 

Any answers and advice help. Thank you and please feel free to message me with any questions regarding the entire CR1 application process - it's not as daunting as it seems, promise!

You will need a stamp from the military allowing him to leave the country, even if he is still enrolled in college.  He will need to go get this done.  Usually they only give these out during college break times, but I have known for them to make exceptions.  

 

And from my understanding thru research (my husband is in the same situation).  He can not return until after he is 30 or becomes a citizen.

November 13th, 2017 - I-130 sent

November 24th, 2017 - NOA1 (Received Hard Copy by Mail)

June 7th, 2018 - Online Case Update - Case Transferred and /New Office Has Jurisdiction

June 8th, 2018 - was told my petition is being sent to The National Benefits Center (NBC)

June 8th, 2018 - Online Case Update - we received your case

June 8th, 2018 - Online Case Update - Case Transferred and New Office Has Jurisdiction

June 14th, 2018- Hard Copy of Transfer Notice (sent 6/6/18)

July 9th, 2018- worked with caseworker at congressional office, made a inquiry

August 3rd, 2018 - caseworker was told by liaison that my case had been transferred to another department for review

August 17th, 2018 - expedite request sent per caseworker, due to USCIS error.

August 27th, 2018 - our petition was yet again sent to the wrong office (Adoption Unit...) another request for expedite was placed by caseworker.

August 30th, 2018 - petition was sent BACK to Nebraska Service Center.  Caseworker spoke with NSC liaison detailing the erroneous transfer that has put your case behind normal processing times, as well as the delays/lack of communication/action at NBC"

September 13th, 2018 - Case was transferred to a new office

September 14th, 2018 - Case transferred and new office has jurisdiction - called and they said it was at Nebraska still...

September 14th, 2018 - Case is APPROVED

September 17th, 2018 - Hard Copy NOA2 Received (PD SAYS 9/13/18)

September 26th, 2018 - Sent to the Department of State (online notification)

October 2nd, 2018 - NVC Received

October 26th, 2018 - Case # Received via email

November 7-9th, 2018 - Submitted DS260 and AOS, Civil Documents, etc. via CEAC

November 14th, 2018 - new police certificate was uploaded

November 27th, 2018 - Case Complete at NVC!

Feb 14, 2019 - Received interview date via email

March 5th, 2019 - scheduled interview date - APPROVED
March 9th, 2019 - Visa in Hand

Okay - update!  We received the document with the stamp on it allowing him to travel. However, now my concern is that his visa says immigration, not tourist or student, etc. Has anyone run into issues with this before? On all the other forums that I have seen, everyone says that the airport officials don’t actually check and just want to see that there is the travel permission. But they are all outdated forums so I want to hear from my VJ friends who have Egyptian spouses who are 1. Still students and 2. Have no yet completed their military service.

We made it trough without any issues! It was nerve wracking - I didn’t feel comfortable until after Customs and Border Patrol here in the States! 

 

They checked his military travel clearance at the ticket booth and security line (they kept it at that point). The ticket booth didn’t even read, just checked to make sure we had it but at security she was very focused on it for legitimacy. 

 

Then, at our layover in Italy, they checked his passport and visa and asked a few questions before we were allowed on the plane.

 

CBP in the states was really nice but took about an hour to get through.

I am so happy to hear you are both together in the States!  YAY!!!  What port of entry did you go into?

 

My husband and I are very similar to your case, meaning he is still in school , etc.

 

I sent you a PM here on VJ?  Did you get it?  Let me know, otherwise I will shoot you over another one!  We would love your advice and hear more about the process from you.

 

We literally just got our NOA2 from USCIS TODAY in the mail, after 300 days waiting there... :)
