I have been with her for over a year and have a lot of evidence to that effect. I can marry her once she is in Hong Kong and file a CR-1 then.

I thought you had not met

 

If she claims Asylum in Hong Kong it would be to stay there

 

I did not think Saudi did permanent residence. Just temp.

if she manages to be legally in HK for at least the time for you to file the CR-1, which is currently 14-16 months if everything goes ok, then you may overcome these problems.

So she is the child of a Chadian, and a Saudi mother. Under Saudi law she should have citizenship but the rule of law is a joke there. She has permeant residency by being her mothers child thats it.

Hong Kong isn't a signatory to the 1951 convention, its not true asylum its a stay of deportation while the UNHCR looks for a country willing to resettle her.

if you can manage to get her into a country that is not so abrupt into deporting her back to Chad or Saudi Arabia and her getting a temporary residency for the time being....a k-1 would be the fastest rout in my opinion. How are you guys going to meet in Saudi Arabia? or you going to meet in HK?

It is a wise move on your part to speak with an attorney because this sounds like a complicated case and maybe beyond the scope of VJ. Like someone else said, it sounds like an uphill battle. My thinking is that you are going to need a lot of convincing evidence to show that your marriage will be bona fide she is not merely seeking asylum in the United States.  You haven't met her yet and you are saying you have lots of evidence?

 

Listen to your lawyer tomorrow but I do wonder if, given all of the circumstances,  that you might have a stronger case with a CR1. 

 

A side question is what would her father say or do if she marries you?

Who in their right mind seeks asylum in a place ruled by China.

 

Your fiancee can not apply for US asylum from China.  If she seeks asylum in HK, then she is asking the Chinese Government for protection.  Her asylum case would be evaluated under Chinese laws by the Chinese Government.

He will say he is going to kill her to protect his honor. also thank you, if america isnt a good option I am also a Canadian citizen. I just want her to be safe and have a life with her.

Okay.  People in HK are probably satisfy with the reality of one country, two systems.  Democracy protesters are happy with the good common law justice system there under Beijing rule.  China doesn't need oil from Saudi Arabia.  Surely, HK under Beijing rule will be happy to help.

have you consider your options how you could take her to Canada instead? VJ is not the place you are going to find a solution to this problem.
