What name should you put in the mail as a sender when applying for replacement of Green Card due to name change (e.g. marriage, court order)

Hi! I just want to ask if what name should one put as a sender for the documents needed for application for name change (e.g. marriage, court order) on green card? Should the current legal name be used on the letter mail or the previous name of the applicant?

Your current legal name. Your previous name is not your name anymore.

[01/10, 2018]  - DAY 323  (day 2149) (N-400) Naturalization Oath Ceremony (5 years, 10 months, 19 days)

[01/10, 2018]  - DAY 001  (day 2149) (US Passport) Applied for US Passport, regular processing

01/25, 2018]  - DAY 015  (day 2164) (US Passport) Passport in hand (5 years, 11 months, 3 days from start of Journey.)

Use the same you put on the forms you are mailing, which should be your current legal name.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

31 Jul 2014: Mailed AOS Packet

12 Feb 2015: AOS Interview - Approved

22 Feb 2017: Mailed ROC Packet

08 Aug 2018: ROC Approved

I just called the USCIS  about this. 

 

My situation was:

 

Before marriage, got SSN for (then) fiance with I-94. Got married. Marriage court messed up our marriage certificate so we didn't get proof of marriage until after (now) wife's 90 days (I-94) expired. SS office would not let us change her name even though we got married within the 90 days because they required a valid I-94 or EAD (which she won't get until we had filed AOS.)


We thought we were stuck. So I called the USCIS. They said that the marriage certificate is legal proof of name change regardless of what the SS office had listed and that their records took precedent over the SS office's. They said use my last name for my wife's current name and list her former maiden name in the AOS as a previous name. Then go to the SS office after receiving EAD to update her SS Card.

I would assume the 3- 6 months it takes to get the EAD..... The EAD gives the spouse the ability to work, and also gives the SS office the document needed to change names in their office.

 

The green card that comes after the AOS interview would automatically have the updated last name.
