Hi all,

Please I need a little help.

 

I applied for my green card earlier this year in early march, I just got an RFE letter and the only thing that was requested was 

 

The "Sponsors Household Size" on the joint sponsor Form I-864, Affidavit of support (revision sate 07/02/2015), was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable. The joint sponsor must correct and/or complete and return Page 4 of Form I-864.

 

The thing is my wife hasn't had a job in a year due to personal reasons, bur she just got a new job less than a month ago. I have a friend of mine who is the sponsor, he is single and makes above 60k a year. I was wondering what the sponsor household size would be? How do I fill out the part 5 on page 4 correctly.

 

Im kinda confused on what to do, please advice accordingly,

The sponsor's household size must always be at least 2: themself + the intending immigrant being sponsored. They would also count any of their own dependents (i.e. a spouse, under-021 children, those claimed on taxes, etc.).

Okay thanks very much. I really appreciate your response.

 

Also the old I-864 is expired so I'm filling out the whole new one all over again which was recently received. Do I have to include the tax forms, W2 and employment letter again? Or just the form and fill out the taxes information. Since we included all that the last time.

 

Or do I just fill page 4 alone?

A Joint Sponsor can not have a household of 0 or 1.  A Joint Sponsor's household must be at least 2.  Here you have a single Joint Sponsor + the intending immigrant, so it's at least 2.  It could be more depending whether the JS has dependents or sponsored other immigrants.

A complete package is better than just a single page. 

How is the Joint Sponsor going to sign that single page?  (He can't.)  Can you just slip it a replacement page into a legal contract that is already signed?  (No, you can not alter a signed contract with a new page.)

Petitioner is not included in the a joint sponsor's I-864's household size (unless they otherwise are a dependent of the joint sponsor using the same rules noted above...i.e. claimed on taxes, under-21 child, etc.).

Who else lives in the same residence may or may not be included. For instance, a parent or sibling that earns their own income and is not claimed on taxes would not be included.

The petitioner is not included in the JS's household unless the petitioner falls into one of the categories listed.

The Joint Sponsor is a friend.  The petitioner is a USC.  Therefore, there doesn't seem like there is an apparent reason to include the petitioner in the JS's household count.
