Can I have my interview outside my home country?

Hi everyone. I am new here and would like to ask a few questions before we lodge our application next month. I am an international student living in Auckland, New Zealand. I am originally from the Philippines and currently completing my studies until next year. My fiance lives in the US and we plan to marry next year after I graduate. My question is, can I schedule my visa interview here or do I have to go back to the Philippines for it? Anyone here who had the same situation in NZ as well? Will really appreciate your responses. Thank you!

Timeline

As long as you are a legal resident in New Zealand at the time of your interview, you can have your interview there.

 

Your interview takes place at the place of your residence, not of citizenship (I for example had my interview in Brussels but I am not Belgian, just a resident in Belgium).

My study visa will expire next year and we are looking at applying for either a tourist visa or working visa while waiting for graduation. In your opinion, would I still be allowed to apply for interview should I opt for the tourist visa?

A US tourist visa does not affect your immigration case.  Your immigration visa interview is at the US Embassy/Consulate you select and your choice should be based on your legal status there.   

 

There is no working visa that you can apply for.  Work visas requires a US employer to sponsor you.

 

Where do you want to get marry in the PI, NZ, or the US?

 

Do you understand that if you enter the US on the K-1 visa, you will not be able to legally work for more than half a year?  

 

Do you understand that a tourist visa is not a short cut to immigrate to the US?  

 

Do you understand that it is immigration fraud to use a tourist visa to enter the US with the intent to stay to immigrate?

She was talking about applying for a tourist visa for New Zealand after her student visa to have her interview there, not a tourist visa for the US...

A tourist visa shouldn't be enough to have your interview in New Zealand, but it's the embassy's choice in the end.

 

When does your student visa expire? Do you have enough time between when you plan on applying and its expiration so that you still have a valid residency in New Zealand by the time your interview comes up?

Oh wow. To those 3 "Do You Understand.." questions, YES I am fully aware of those and in case my posts were not that clear --

 

I was not looking for a US employer to sponsor me for I already have a current job here at NZ while studying at the same time.

 

We would like to get married in the US

 

I do understand the circumstances after being a granted a K1 visa when it comes to work.

 

I do understand that a tourist visa is not a short cut, and that was not even my intention  to begin with.

 

I do understand what immigration fraud is, because I have studied them myself.

That's the most complicated part. We are looking at January for NOA2 (given that it's within normal processing timeframe), and my study visa expires on March 2018 which means I have to apply for another NZ visa in Feb in order for me to stay here legally. I want to stay here until my interview so I can continue working and save for the wedding. 

 

We're probably looking at April for the medical and interview.

Bummer, you only need a couple a more months. I think a work visa is your best bet if that’s doable.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm alo experiencing this situation. My beneficiary is working legally in Australia now. But her valid working visa will expire soon. Then she wants to apply for a tourist visa, so she can legally extends her stay in Australia to have the interview for K1 visa

The same question is, can she have the interview while she's on tourist visa?

Is the tourist visa count as legal residence?  Thank you!!!!
