Hi. I’m Filipino and I moved to japan when I was 5 and living here ever since. I am dating with the navy guy here who is leaving in 2019 March. We are planning to get married but there’s a big problem. I have two BC cause of the late registration. Before we even plan to get married, I was planning on applying to become a Japanese citizen but the Japanese side found out that I have two BC. Now I have to go back to the Philippines to do the hearing and erase my bc that I have right now. ( so technically it’s kind of illegal that I’m here in japan ) then after that hearing thing at the court I have to wait for about 6 months to get my real BC with red ribbon. My parents want me to get Japanese citizenship but at the same time they don’t know I’m trying to get married and there is no point for me to get it since I’m planning on getting married to him and move to the states. So my question is I know I better wait to get my bc fixed and get the real one first but how long will it take for me to do the process as a Filipino? And should we get married in here japan or wait and i fly to the states and get married there ? If I wait to get my Japanese citizenship that’s gonna be 6 months to get my real BC first + 9 months to apply to a Japanese citizenship so that’s going to be a year and half. And start the process from there. If it’s going to be about the same amount of time to get married as Filipino I just wanna start the process as Filipino after I get my real BC. If anyone can help me or give me some advice that’ll be really cool.

Doesn't matter "who" you start the process as. Since you're in the Japan "illegally " then I assume DCF is not available for you. 

 

There are 2 options for you:

1. Cr1 visa - spouse visa that takes 12 to 14 months to process. In this scenario you marry outside of the US. 

2. K1 visa - fiance visa that takes about 7 to 10 months and you have to marry in the US. 

 

I'll let you check the details of those visas. There is enough guides on here for you. 

 

With everything you have going on - don't expect to move to the US anytime soon. Definately not until March 2019.

Thank you so much for your reply! I really appreciate it. My boyfriend is trying to extend his stay in japan til 2020 August and if that’s the case we can do the process little by little clearly. I’m hoping he could stay and he’s asking for his senior chief to change his orders. Our plan as of right now is to wait to get my real bc and start from there. And we both understand that at some point we will be separated. But I’m hoping he can stay here longer.

Get your BC fixed and then apply for any immigration benefits either in Japan and/or US. I would go ahead and get japanese citizenship. You have no idea what is going to happen when and if you get here to the US. Things change over time and so do people. Good luck

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail
