I will have my K1 visa interview soon! I canā€™t help but to worry about my case. šŸ˜ I applied a tourist visa before February 2015 and it was denied. I applied to seeĀ my sister since she invited to visit her. She was also the person who was supposed to sponsor my 5 months vacation (length of stay I put in my DS160) During that interview. All the questions became about my sisters background. I was asked if she is a US Citizen and I said Yes. How did she become a US Citizen?... I told the CO that her husband is a US citizen. Then was asked about the Visa she had and I said tourist visa. And also asked how did she obtain that visa. I told the CO that she was askedĀ to go and attend training inĀ Texas (She was working under BPO industry - AIG)Ā and was granted multiple visa when she applied. So after that day... I realized how many redflags I had in my application. I didnā€™t realizeĀ that until the that day was over. Like what they said... you just have to be honest so thatā€™s what I did. Put 5 months of vacation. I was on a long vacation waiting for the second semester. I was a student that time. So now... in my upcoming interview... in the DS160 thereā€™s a part of it about ā€œrelativesā€ in the US and I know I need to put my sister in my application because for sure they would have a record of my previous application. Now Iā€™m worried that my history and my sisterā€™s background might affect my K1 visa Interview. Iā€™m worried that they might asked again about my sistersā€™ and give a denial answer. What do you think of my situation? Do you thing that will affect my interview? What if they ask and focus again into my sisterā€™s background? I met my FiancĆ© Feb 2014 and weā€™ve Been together for more than 4 years now...Ā He visited me twice.Ā

No, it will not affect it. The k-1 is an immigrant petition, not a non-immigrant petition.Ā

Your previous denial wonā€™t affect your K-1 unless you lied in either application process.Ā

Looking at what you have written, you say you have known your fiancĆ© since 2014 and you applied for a tourist visa to visit your sister for five months in 2015. Really? You were going to the country where your fiancĆ© lives for 5 months but you would only be seeing your sister? Thatā€™s unlikely. Did you mention that you have a boyfriend in the USA during that tourist visa application process? That could be a problem.

As long as you were honest with your previous interview and will be honest inĀ your upcoming interview, this situation should cause no issue. Ā Many applicants have also been previously denied a tourist visa and it did not impact the K1 visa.

Yes that is correct. It just happened that I know my FiancĆ© since 2014 when my sister invited to visit her since I was half a year break from school. I didnā€™t mention that I have a boyfriend that time since I already had the idea that it would cause even a good reason to deny me. So I didnā€™t mention that. I know to myself that the reason was first: the length of stay and second they thought maybe if they would grant me a tourist visa I might use it for a wrong purpose. Since they found out that my sister became US Citizen with a wrong visa.

I didnā€™t lie in my previous application. All were honest answers. And didnā€™t even lie in my interview althou I already know they were asking me questions which would cause me a denial.Ā

But I guaranteeĀ the first question asked was "what is the purpose of your trip/who are you going to visit?" Or something along that line. She was economical with the truth if she only mentioned her sister. I'll wager she was planning to spend the lion's share of the time with her boyfriend and maybe a week or so with her sister.Ā

So whilst sheĀ may not have been asked the exact question "do you have a boyfriend in the USA?", by her own admission she deliberately omitted that information.Ā

Interesting perspective Scott but a little bit silly. Im sure the question was asked of her 'what is the purpose of your visit?' Its a clear simple question and it needs/needed to be answered honestly. That means the truth -the whole truth- and nothing but the truth. Giving a partial answer or omitting details is misrep.

The CO might see her responses differently and that is what JFH and Damara is raising as a potential problem.Ā  They may see her responses in the previous interview as being intentionally deceptive, which raises the question of what else is being hidden.Ā  There may be nothing, but COs are alert to all the tricks people try to slide by at interview.

Just some semantics: Although the K-1 visa is a nonimmigrant visa, it is processed like an immigrant visa (i.e. the K-1 is processed in the immigrant visa division of the embassy).

I believe you put this information on your k1 application. Just make sure you have the right and honest answer as counselor might ask you about your tourist visa application. At my k1 interview i was asked that i knew my fiancee (now husband) 3 months before i applied my 3rd tourist visa and didn't mention in my tourist visa application. After my answer,Ā  the counselor told me: well i can understand and i see you had applied 2times tourist visa beforeā˜ŗ

No it will not affect you at all. Being denied for a B2 is very common with people from developing countries. Noting to be concerned about as you were honest with your answers. Good luck
