Hello.. need some guidance here since our lawyer is useless and confused.  Apologies if this question has been posted before, I'm sorting through all the threads as we speak...

 

Main Question:  Can we file I-130 in the US, and then file the rest (NVC stage) oversea (S. Korea)?

 

LONG VERSION:

It's been over a year since our NOA1.. we are waiting for NOA2.. hopefully it'll happen in the next month or so.

My spouse and I are currently in the US.  

My company is transferring me (and my spouse) to work overseas (S. Korea) in couple of months.

Is it okay to leave after NOA2 and file the NVC from Korea?  We can stay in Korea as long as we need to.

We can also fly in anytime, if the need arises from the immigration office.

 

I know the best way is to stay in the US and leave when VISA/GREEN CARD is in hand.. but God has interesting plans sometimes :)

Yes, sure.  They don't care where you are.  They just care that they get what they need.
