Affidavit of support when I'm not the financial sponsor?

Timeline

My fiancé and I are young and have been in university together in the UK for 3 years. As such, I'm not employed and haven't been working in USA at all. I have plenty of US family that make decent money and would be willing to sponsor him, do they complete the I-134 for us to take to the interview, or is there a different process for that situation?

I-134 for a k-1 visa. they usually ask for the last 3 years of returns from sponsor and co-sponsor

3/15/2018                  NVC case received

3/22/2018                  NVC case assigned

3/23/2018                  Consulate ready

4/11/2018                  Medical

4/17/2018                  Visa Approved

4/24/2018                  Visa on hand

5/23/2018                  Point of Entry ATL

5/24/2018                  Marriage license, officiant and certificate / applied for SS#

5/31/2018                  AOS/AP/EAD

6/7/2018                    email notification of NOA-1

6/11/2018                  NOA-1 hard copies for AOS/EAD/AP

6/27/2018                  Biometrics for AOS/EAD

7/7/2018                    ready to be scheduled for interview

7/11/2018                  We are still reviewing your case and there are no updates at this time (email from USCIS)

8/22/2018                  We are still reviewing your case and there are no updates at this time (same email again)

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

So would I be the sponsor and my family member with money would be the co-sponsor? Would we both have to complete I-134? And what do I do if I literally don't have any returns due to being a minor and then moving to the UK for my adult life so far?

you are right, the petitioner is the sponsor and the person with the money is the co-sponsor.

yes, two I-134 forms

you only need to provide from income earned as an adult. All USC are required to file a return for income earned anywhere in the world. There are these treaties with certain countries, but that i am not familiar with. Maybe the UK is one of those. You will need to find out if filing for US returns is not required because you don't have income in the US.

All USCs living overseas must file a federal tax return each year, unless they earn below $4050 for that year. It's unlikely that you will have to pay any tax, but you must still file if you are above $4050 in any given year. The U.K. has a tax treaty with the USA to prevent being double-taxed but the obligation to file remains. 

 

 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes your relative completes an I -134. London typically accepts the one I-134 from the one with income. It doesn't have to be the fiancé. They will not need a tax return from you, but you will need one when you do the I-864 for adjustment of status. As explained above, you likely don't owe, but you do file if you had  income while at Uni exceeding the filing threshold for a single person. 

 

Your relative can prove income for the I-134 with their 2017 tax return, a tax transcript being easier than photocopy of the full return+W2. They will not need three years.  Or they can get an employer letter stating their job and salary. 

 

This is London K1 specific information.
