I am US citizen, I am from Nicaragua my country have a level 3 out of 4 to Reconsider travel to Nicaragua due to crime, civil unrest, and limited healthcare availability. 
Embassy is close over there so we need to do all the application in Costa Rica. 
What would be the fastest way to have my kid in USA? Many people, specially young student from university like my son 19 years old son are being kill, disappear, torture, taking to jail because they protest against communist government. So we do not have time to wait for more than a year for I-130 and I-485 process. 
Can we apply for a non immigrant visa and while he is in USA, can we apply for I-130 and I-485 with no issues? 
Or what would be the best way to handle this situation?

It would be an issue because that's a visa fraud. 

 

Sorry but you have to file i130 and wait just like everyone else.

You can petition for him and request an expedite. If you can prove the grounds for it it will go faster. If he has the ability to move to a neighboring country and establish temporary residence there he can interview there. But what you are suggesting is visa fraud and cannot be done.
