Can you explain to me what what these lawsuits are !!! Is it something that guarantees getting waivers approved !!

It is called a writ of mandamus, so basically if you spent more that 6months in the administrative  processing and you tried to email the embassy during this time and tried to get a congress man to ask about your case and all of these options didnt work, you can file a lawsuit complaining about unreasonable delay in you case, the federal judge will force the department of state and the embassy to make a judgment in your case in 2 or 3 . So if the embassy sees that you deserve the visa you will get it, if not you will denied, not guaranteed to get the visa, but it guaranteed to get a decision either yes or no in 2 or 3 months.

Google travel ban mandamus. Half a dozen lawyers show up. I don't want to recommend one, since this is a very straightforward case, and ideally should not take more than a bit of paperwork, unless you have other red flags in your case and would have gone into AP outside of travel ban. Its a travesty. Basically all the ban has become is an extra 4-5 K + 1 year apart.

 

The idiocy of this policy is that if i was an Iranian F1 student, I could get my spouse here in no time. But as a US citizen, I cannot. Its unbelievable.

We shall see! I already started the Mandamus last week. Let's see what happens!

Keep us posted. The sad thing is most of the money is being spent on hotels, airlines, landlords in foreign countries, and its tens of thousands of dollars per affected case. IF you multiply this by atleast 10 thousand affected cases at 10K each (at least - i know i have spent more than that in travel and accommodation costs to visit my spouse) - thats a hundred million dollars. And 10K is on the lower side of the scale. I know people who have spent close to 100K (especially yemenis) So its atleast a 100 million dollars per year probably a LOT more that could have been spent in the US economy thats now gone forever.

Regarding the expenses, I definitely agree with you. I myself have spent close to 20k because of this delay, most of which are due to traveling cost etc..

 

Hopefully this stupid AP ends soooooon.

As much as I scream and yell about the stupidity of this policy and this administration, I am eternally grateful that I live in a country that empowers me as a citizen to drag these enormously powerful entities (Department of State, USCIS, embassies) to court and demand justice. There are probably very few countries in the world where ordinary citizens are this empowered. God bless this country and the principles it was founded on. May it stay this way forever.

Ive never heard of Curtis or even have his contact information. Can you provide those please. Where is he based?

I never thought this day would come. The riyadh embassy made mention to us that hopefully this means a more streamline and shorter processing time for cases. Being that we passed the 1 year mark from the interview, we were asked to redo and obtain the medical report (good for 6 months) and police report (good for 1 year). We also had to update the DS-260 form. The moment we did all that and mailed my wife's passport, the embassy took only 3 business days to issue/print the visa. It was all a quick process once we emerged from AP thank God.

Also as mentioned by other users, it is insane the amount of money we've had to spend being torn apart this long and agree with others how counter-intuitive this waiver process was all in all. It's funny too because I was SO CLOSE to pulling the trigger on a WOM with Curtis and paying the 5k. I was actually on the phone with him a second time when suddenly I received an unprovoked update on CEAC and reply from a previous inquiry email (sent a week before considering WOM) i sent to the embassy stating that they anticipated our case to complete processing soon and to expect an email asking for updated documents. Curtis told me it looks like they want to give you a visa and recommended I hold on the WOM and to contact him if anything changes. He was right and definitely meant well for us. 

It was a long ride guys and we want to thank you all for the support and warm wishes. I pray that you all get reunited with your spouses very soon and live a long, healthy and happy life with each other. You all deserve this basic right. Wishing you all the best!

I am a syrian citizen who lives in Syria and my wife is American living in USA ,, i had my interview a about 2 months  ago and a few days ago the embassy in Amman “ where I had my interview “ called me on a phone call and asked me to send my passport to the embassy and I did . 

The day they got my passport the changed our CEAC status from “ Refused “ to “ Administrative Processing “ . 

I had another call from the embassy just yesterday too asking for some details about me. 

Do you think asking for my passport means our visa was approved!! And how long do you think it’d take to finish all Processing and return my passport !! Thanks for any reply and congrats again for your success .

did u submit the ds-5535 before. if not maybe they will ask you to submit it and then AP
