Differences between my brother’s wife case and my wife’s:

1- my brother’s is IR1, my wife is CR1

2- my brother has a new born, my wife and I don’t.

3- my brother is on a work visa in Saudi and showed up to the interview with her, I wasn’t there at the interview and I live in the states.

Hello Everyone,

I have two cases here, my wife’s and my brother’s wife. Both interviewed in Riyadh.

so my wife interviewed on December 2018 and got a 212(f) refusal because she holds a Yemeni passport. You know, the refusal sheet included all that “review for waiver eligibility” stuff. Anyways, she’s been a resident of Saudi since 2011. We were asked to submit the DS-5535 right after the interview, which we did. The ceac site got a “case last updated” on Jan 7th. That was the last update on our case till this moment.

I email the embassy about once a month since the interview. Sometimes they don’t even respond, sometimes they respond with a one liner! The generic bs!!

WHAT SHOULD I EXPECT?!!!

My brother’s wife in the other hand; interviewed on June 3rd 2019. She received a 221(g) and crapload of documents requested. Plus, they asked for a copy of her passport so they can give them a DS-5535 to submit. At the time, her passport was sent to the yemeni embassy to get renewed so every time they called asking for the copy of the passport my brother kept telling them to wait. A couple of weeks passed after the interview, some lady from the embassy called and said “congratulations we will issue your wife’s visa”!!! BUT WAIT, AREN’T THEY WAITING ON A COPY OF THE PASSPORT TO SINK ME INTO AP FOR EVER?!!!

Well, they told him to mail the passport with a new I-864 (joint financial sponsor). We prepared the I-864 and he received the renewed passport then mailed it to them. His case remained refused until it got issued on July 15, 2019. Basically 40 days after the interview. Forgot to add, my brother’s wife is on a governmental visit visa that needs to be renewed every 3 months and she had to get a police certificate from both countries Yemen and Saudi.

Any who, the question that’s blowing my mind at the moment is, if you delay the completeness of the DS-5535, would that result in you avoiding the AP nonsense?!!

Your thoughts on both cases please!

maybe as they really don't know what they are doing. So yes maybe

I take it you were there. Did the attorney for the DOS bring up the automated pre interview screening system? I feel they rushed to implement it before yesterday hearing.

Do we have any information on this automated pre-interview screening system ? I can find hardly anything no it online. Is this going to help those already waiting on AP ?

It was implemented in June. In may the state department mentioned it.

Did you file it?  :)Did they give you any estimate of how long the WoM will take? We are looking to file on or about August 8th.

Yup, we filed it just last week. No estimate; it may take some time between 30 to 60 days. it depends.

Good luck with your filing; I guess you are going with Curtis in a group case (I remember him mentioning Aug. 8th as a filing date.

All the best to every one

Congrats for the both of you

I am a Syrian citizen married to America woman and our visa type is CR1 ... I have a question for you pls .. I had my interview in Amman a month ago and I got a phone call from the embassy a week ago asking me to send my passport to the embassy and I did .. the passport was delivered yesterday .. do you think asking for my passport  means they have approved my visa and that they need the passport to stamp a visa on it !!

FYI, my visa status used to show “ Refused “ but just yesterday which is the day they got my passport it was changed into “ Administrative Processing “ .

Ad appreciate any info on how long could it take to return my passport !!

Hello, my fiancé had this interview on April 10, 2019 he’s not from a ban country he’s Pakistani but we’ve been in a AP ever since. They gave my fiancé his passport back. He’s been a resident of Saudi Arabia since childhood. I’m posting here because I see a lot of ppl have their fiancés from Saudi Arabia. Does anybody know the length of AP and also is it normal for the to send back passport if they intend to approve ?

AP is open-ended.  It can take weeks, months, or years.  It can not be waived or expedited.  If they returned his passport, either they have doubts about the case or they knew it would be an extended AP........there is just no way to know how long until their decision is made.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ali.. congratulation to you  as well. Believe me if their intention is to refuse your  Visa they won't even bother asking about your passport.  The only difference between your case and ours, it has been more than six months since my wife did her medical exam,  so she has to redo her medical exam. In your  situation you don't have to. Hope that answer your question
