K1 Status mismatched for SSN

Hi everyone,

I apologize if this isn’t the right forum.

I’ve been in the US for three weeks now and I haven’t gotten married, my wedding is on August 25th.

This last Monday I went to the SSN office and tried to get my card, the lady was super nice but told me she couldn’t give it to me because my status was mismatched, which means I no longer appear as a K1 alien. She told me that it looks like someone pre-applied for me for Work Authorization and that’s why I have an alien number (which she saw on the copy of my NOA2 I gave her). I know that’s not possible and that’s not how the process goes.

So my two options are:

1. Wait for SS to confirm my status with USCIS, which could take weeks and it might not even be ready before my wedding and my name change:

2. She said that if the first option can’t be done, I need to wait to have a work authorization card in my hands. Which I know won’t happen for another 6 months.

My two biggest concerns are how to get on my soon to be husband medical insurance if I don’t have a SSN, and if I will be able to open a joint bank account that we can use as proof for the adjustment of status.

I also met a couple in my neighborhood, and because of this same problem, he couldn’t get his California driver’s license.

What can I do? Thanks everyone :)

is this a case of common name issue...

1) normally you can get SS# under k-1 before your i-94 is 2 weeks to expire. As far as needing a SS# for getting married is new to me. you wont need it. Usually k-1 apply for ss# w/o problems and get it and after marriage they go and  change it.

2) yes, that is correct

Some people say you can get medical insurance w/o SS#, but that was not possible with my employer. We had to wait for SS#, period. Bank account was another problem, no SS#, no joint bank account either.

I recommend either a) going back and hopefully will be dealing with someone different or b) going to a different SS office. Often SS employees don't know what the heck they're doing. You've only been in the US for 3 weeks, so you shouldn't have any problems getting your SSN. I know both my suggestions are painful (lot of time wasted), but I think that's all you can do at this point.

I also assume you've never received a SSN before right?

My suggestion would be to wait another week and try going again (maybe even a different office).

Could it be the employee was confused or you were not in the SAVE system correctly yet?

Can't hurt to try again......

Also my husband received his alien number on his K1 visa which they followed him through to AOS, so I don't see what the alien number has to do with pre-applying for work authorization? It sounds like she was confused??

As far as health insurance, have your so to be husband talk to his HR department at work and tell them the situation. My HR department said it would be fine to put my husband on my health insurance without a SS# but to let them know what it is when he received it. I am not sure it they may have a similar policy.

It's actually possible (& incredibly foolish) to apply for an EAD based on K1 status. (By the time one would receive the EAD, it'd have been already expired as it's only valid for the 90-day period).

I wonder if there's a glitch in the system showing that you applied for this?

In California u can be on your finance/ spouse insurance prior to marriage.  With my ex we had to sign a domestic partnership form and turn into HR as well as copy of his I-94. Side note I do work for a big corporation which hires many immigrants to improve diversity and so our insurance is pretty flexible even my parents can go on my insurance as long as they have permanent residency in CA.

I'm having the same problem, the employees at social security were very nice but were unable to help me. They say there is a mismatch on the immigration status when they try to get DHS clearance. An EAD application appears and I'm sure I didnt apply for one yet so I don't know what else to do.

They recommended me to call USCIS but it is impossible to get a human on the line and I'm pretty confident that it will not do anything.

They sent a request to DHS for manual verification but after a month and unable to verify me they needed to close my application.

Im very worried since we don't heard yet from my husband's HR department to confirm I can enroll in his insurance without a SSN.

I was able to open an account without SSN at the local credit union.

Does anyone has any tip on what I can do?

Thank you in advance!

José
