Form I-864A as the immigrant question.

I filed for AOS in January and my husband made enough money last year to sponsor me no problem and might even this year. We likely won't have an interview til around February 2019 due to my office. My question is currently we are in a tough spot as my husband has a lot of medical issues. He has a written warning from his work place due to all his missed time and one more and they fire him. However we have decided since he is not happy there he is going to put his two weeks in and move on to something else. I currently work at the same office albeit a much better job and will make enough money for us both. Ok the question and I did read the instructions for the supplemental income....am I reading this right that because we file our taxes jointly that we can use my, the immigrant's, income in conjunction with the sponsor, my husband, without having to find a joint sponsor if jointly we meet the requirements?

You were a k1 right? and now in the US working with an EAD from a pending 485? If so-

 

The 864 form is considered valid when submitted. Meaning as long as it was accurate and sufficient when submitted it doesnt matter if the situation/income changed. The form is still valid to be used when you adjust. You are not required to update it.

 

You may or may not have an interview. If you do they can ask you in the interview for a new 864. Sometimes they do (if the conversation goes that way) sometimes they dont. If they ASK for an updated 864- you have to provide it. If they dont ask you can offer it or leave it alone.

 

Yes- your income will count. If you get an interview complete a new 864 with your income and proof. Bring it with you in case its needed.

Timeline

As mentioned if they ask for a new i864 since they may ask about his employment situation. Have one ready with paystubs/employer letter. You do not need a i864A since you are the immigrant, the i864 has a place to show your earnings.
