Timeline

I haven’t been able to find any threads about experience with same sex couples with children trying to immigrate to the US. 

 

i am a us citizen with Canadian PR, married to a Canadian citizen with two Canadian children. Married for 2 years.  Submitted our papers and they were received June 23rd.. we had our first NOA Stating they had received our applications and being forwarded to the Nebraska facility. Now it has been radio silence and it is mid August. 

 

Has anyone had any experience with same sex marriages trying to immigrate to the US? 

 

Should it be taking this long to hear what happens next ? They received our papers and that is all the letters said. Nothing telling us what happens next.

After you first hear (NOA1) you won't hear again for months and months, this is normal. My case was 'fast' as it took only 6 months to hear again from USCIS (NOA2). Find the thread for filers for your month, make a timeline look at the predicted times here, for me they were pretty spot on.

 

The whole process will take about a year - maybe even a bit over, and it's not an exaggerated hyperbole type 'it'll take a year'. It is just long.

12/26/17 - NOA1

06/27/18 - NOA2 (+183 days)

07/11/18 - Case sent to NVC (+14 days)

07/18/18 - NVC Received (+7 days)

08/10/18 - NVC Case Number (+23 days)

09/06/18 - All Docs Submitted (+27 days)

09/19/18 - Case Complete at NVC (+13 days)

10/18/18 -  Interview appointment letter received (+29 days)

11/20/18 - Interview Date (+33 days) - APPROVED!

11/26/18 - Visa Received

Same sex, different Sex, doesn’t matter. They just want to make sure the union is bonafide. Also if you sent it in June 23rd of this year then you have to be way more patient than that. I-130’s take 12-15 months to process.

I suppose that seeing the Nebraska processing timelines was 7-9.5 months got us feeling a bit ambitious. thank you all for your responses.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

You'll have plenty of time to learn the process during the black hole between receipt and petition approval.  That you are a same sex couple (WITH CHILDREN) may or may not be an issue depending on the children, and the other natural parent.  Children cannot immigrate without the permission of the other parent, the death of the other parent, or a court order giving full custody with no residence restrictions to the parent they would immigrate with.  If you have that sorted out, one, two, or which gender doesn't matter.

Patience. 

Current average VJ member processing time in the last year, for I-130 spouse visas, from NOA1 receipt until consular interview, is 410 days.
