Unless she actually attends an interview at a US embassy or consulate and gets a visa stamp in her passport that says EB1, she must not go. If she only gets a tourist visa (B) or is told she doesn’t need to do anything (they tell her to travel on VWP /ESTA being Austrian) then this IS a scam at best and much more dangerous at worst. Don’t be fooled into thinking human trafficking doesn’t happen in the US.

Look, I"m not saying this to be mean or rude or whatever but... no legitimate employer is going to be ABLE to get a work visa for a MASSEUSE. Which here, ahem, sometimes, cough, is something else entirely. Certainly not all of them, but many of them, and especially foreigners. Just an observation.  So if she IS being moved here, I'd have great reservations about what is REALLY going on.

 

My future step son got a work visa through yahoo because he is a GENIUS. not just proud almost step mom saying that, FREAKING GENIUS.  sorry, but a masseuse doesn't go anywhere near that level of intelligence or importance to the Country.  Dime a dozen, here.

 

You can marry anywhere, but no matter WHERE you get married, you still have to go through the process. you have to wait for her to get her green card (if that even comes) and then for the CR1 process. You are looking at YEARS.  K1 process even longer since you have to wait for her to be a USC.

Yes but the petition wont be adjusted will the Petitioner is a US Citizen.  Will not work for a K1 visa, but yes for a spouse.

Exactly. I’m not quite getting the people who seem “entertained” by this. I know someone who works with victims of trafficking, and it’s horrendous what these people go through.

Petitions can be adjudicated at consulates, doesn’t need to adjust.

You seem very desperate to immigrate to the US.

 

First, you want visitor visa to see your brother in US.  Visa denied.

 

Second, you want K-1 visa for US fiancee who works in hotel management.  A fiancee that you have never met.  What happened to her?

 

Now, you have a foreign fiancee who got a EB1 visa as a masseuse, and you would like to immigrate through her.

Doesn't look right. In addition to the possibility that this is human trafficking/sex work/scam, EB1 is actually a green card. It is neither a work permit, nor a work visa. You can get it processed directly at the consulate but somewhat unlikely with this job title. Typically people arrive in the US first with H1B or L1, then adjust to EB1.

 

There is a difference between a green card, a work visa, and a work permit. If this is a serious offer, you should find out which one this is as all of them have different options for bringing spouses, and no, you don't have to be a US citizen to bring your spouse over. Some non-immigrant categories are actually much easier. Anecdotally, Satya Nadella's (Microsoft CEO) story is an interesting one for those interested in reading up on it.

 

If she is truly a masseuse and there are no other concerns for her safety, is this a temporary job, at a resort, cruise ship, casino? That could be an H2B visa instead which rarely progresses to a green card petition.
