Hello, Im from algeria  and my girlfriend she is european and she live in austria country , so she will go to usa with permit work ( visa work) so they told her with this type of visa she can get green card as employe 

so in this case she can bring me with her  because we are just a couple we aren't yet get marry .so i need some advice what i will do

she can not bring her boyfriend.

 

she could petition you if you get married and she gets citizenship (might be not right on that but i think you have to be a USC to petition family)

i 485, 130, EAD and AP

Filed everything ourselves with no RFE's or delays.

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

as stated she can't bring you as her boyfriend.. once she has a GC, she can return, get married and file for you.

 

the  petition will take over 2 years. so the wait will be a very long time for you to come here

So she need to back her in algeria we get married and then can bring me there  but when she have green car where we can get marry in algeria or austria

She can marry you anywhere.

 

She can marry you before or after she gets her green card.

 

As a green card holder, it will take her over 2 years to petition for you before you get a visa.

After getting marry, you may be able to come on a non-immigrant spousal visa based on her work visa.

Because that's how long the process takes.

Because there is no visa category for the fiance of a Green Card holder. 

I am not certain that a person  coming on a working visa as a masseuse will meet the criteria for an employment based GC. This usually requires a specialized employment category .

A green card holder can not file for a K-1.  Only a US citizen can file for a K-1.

 

It takes 2 years because visas for the spouses of green card holders are limited and the current wait is 2 years.

 

She got a work visa as a masseuse?  REALLY?  Surprised.  On what basis do you think her employer is going to get her a green card?    Furthermore, on a spousal visa based on her work visa, you will not be allowed to work.

The bottom line is that there is no quick or easy way for you to come to live and work in the US soon.  Marriage.  Green card for her.  Then filing for you.  That will take over 2 years AFTER she gets a green card.  And, it's going to take years if it's even possible for her to get a green card.  I don't see a path to a green card based on a work permit for a masseuse.  

What is the exact work visa that she has?   H1B?  EB-1?

You don't qualify for a K1 visa. Only US citizens can apply for K1 visas for their fiances. Your girlfriend will not be a citizen for a while (if at all depending on the visa she is coming on). She will be a permanent resident for now so her options are limited.

 

It takes 2 years because there are hundreds of thousands of cases in front of you that needs to be processed. So it is a matter of waiting in a very long line. Also, because she is a permanent resident, there will only be a limited number of visas offered for family. Only for US citizens will there be an unlimited amount of visas available. 

 

Like I said before, you need to be prepared to be separated for a while.

more importantly -

I'm worried about your response about her job, a masseuse is not usually one of the work visa categories for which you can get a green card or even actually a work visa as far as I know.  You need to research the organization to make sure she does not become a victim of human trafficking.
