It really is. Don't forget, you are not alone. So many of us have gone through it. We know that pain, frustration, fear and hope. I hope that, for all of you, you get good news soon.

Ok thanks for the kinds words.  That means a lot.

Sounds like having the petitioner present during the interview helps a lot, especially if the one being petitioned is the nervous type.

Yes, Looking back now I would have went. I literally thought I was not allowed in the interview area with her.

So we are in reset mode, I'm going in Sept to marry her then we will do the I-130 visa, you think If I flew her to Disney in Japan or any place else in the world to Marry that would be some reason to deny again?

I believe a Philippine citizen must get a visa to enter Japan.  Might be a problem getting a visa that fast.

As far as your question though, I wouldn't think so but I don't know.

As Hank said, Hong Kong was very simple.

We looked at Singapore too but there was some residency or other requirement I recall that made Hong Kong better for my wife and I (we were both living in the Philippines at the time).

If you go that route you can apply via airmail/DHL and basically just have to show up 2-3 days before the marriage appointment. I’d suggest staying at least two more days after the ceremony as you can file the Philippines marriage record at the consultate and have it back the next day and then you can apply for a new passport for her the second day (she keeps the old passport and just has to go back to HK after 1-2 months to pick up the new passport). Doing the report of marriage at the consulate means you don’t have to do CFO or wait for the NSO certified marriage certificate before you can get the new passport (still have to do cfo before she leaves the Philippines on an immigrant visa). Also the HK marriage certificate is valid for submittal of the I-130 as HK government is a recognized “legit” government.

Here’s the HK website and if you email questions or anything they’re usually back with thorough answers by the next day or sooner. (Also make sure and ask their fx rate if you’re sending a bank draft in USD as we had to ship a second time because we were like 50 cents short). https://www.immd.gov.hk/eng/contactus/marriage.html

Wow after reading all of this it makes any petitioner/beneficiary nervous! I filled out, created, and sent my petition package in myself and believe I have sent way more evidence than was necessary. We have been dating since December 2017, and then in May 28, 2018 I asked her to marry me. Reason I am saying this is because people are asking if he has not been with her long enough, if that is the case than My fiancee an I are screwed (which I won't believe). I really hope everything works out for OP and anyone else including me who has one they love overseas.

You should be fine, you have typical story.  I suspect there is some undisclosed issues with the OP that has not been mentioned.

Just when you think you have TDS eradicate,  a new case shows up.

It is useless to appeal for K-1 Visa. They will not entertain it. Your petition will now be send back and it will be sitting there until it is expired. The first step you need to do now, try figure out what is the reason of your denial. After you figure it out, then you can make a decision what you want to do next. Either re-apply K-1 Visa again or do spouse visa. Until you figure out the reason or share the exactly the question and answer session during the interview (so that other can share what they might think the reason is), there is nothing you can do.

Totally incorrect.

A friend was recently denied. Did an appeal and was approved.

This time they took a lot of evidence, so I'm going to guess the original Denial was lack of evidence supporting the relationship. They won't say what the original reason was, I'm just guessing. But the appeal worked just fine. Passed the interview earlier today.

I had asked the Embassy about appealing and they wanted something like $1600 just to file the appeal and they stated that appeals rarely work as the original CO has to be the one to change their original opinion of the case.  I was told by the Embassy that refiling would be easier and would probably have a better result.  I believe the $1600 would be the $535 x 3 again ($1605).

But it does happen is my point. Everyone on here is saying it's over.

You should never give up. Always fight with all tools at your disposal. Life always tosses us curveballs, it's how we deal with them that makes us who we are.

This one was done at the CO level, ask for a Consulate General Review of the Decision. This option is only available until the case is returned to the USCIS. So hurry and find out.

I don't think anyone said it was over.  They just said to regroup and rethink how they want to proceed.  Never give up.  There are just a few options available to the OP.  I believe they will get there but this is certainly not a fast or mentally easy journey.
