You almost never get the precise reason, but it says the I-129F is being returned to USCIS. This only happens if they believe it is invalid - i.e. not a bona fide marriage, IMBRA issues, they think you are already married, etc. Otherwise, they refuse the visa but hold the petition at the embassy.

Your Choices:

 

File another K1 for her, which would be a waste of time in my opinion.

 

Marry her and do a CR1 or stay over 6 months in Philippines and do a DCF

 

Doing an appeal would be a waste of time from what I have seen

 

 

Just when you think you have TDS eradicate,  a new case shows up.

I want to PH 3 times to meet her: 3 days, one week and one week. The first time I flew her to Manila and we spent 3 days together, since then we were exclusive and that was a year and 1/2 ago. Then one week in Boracay about 6 months later, then the last time  ( May. I should have married her but thought we would get the K1)I flew her her family and best friend to Cebu to meet them all and we spent the whole time with them.

She is from Zamboanga and I was told its dangerous for westerners. We have hundreds of pictures, she was never married and I'm divorced from another K1 Visa ex-wife .They don't give a reason but maybe thats it. I have a lot of soul searching to do it's a long story but to get to PH now I would need to quit my job (maybe I should I hate it anyway) but worried if I dont find a new one when I get back, they will deny the next visa due to unable to support her ( bull, I always take care of my family) .

 

Has anyone successfully filed the appeal and won?

Fiancés friends say we should have had an agency, any truth to this?

 

The woman denied the girl before our interview and well, she was pregnant the woman conducting the interview and didn't even look at the pictures and all our evidence.

Using an "agency" would not of helped ..  they have no "magic"

 

Some CO's seem to be much more "difficult" than others, I noticed that during my wife's interview.

I know it is hard to get the clear info from her, after the denial, but have her calm down, and help her remember all questions and how she did answer.

 

You described a perfect scenario for a successful K1 visa, but again, what is the age gap, is your ex a pinay also, and related to your fiance, did you meet other girls on the 3 trips, does she or you have other K1 denied/withdraw before,  who file for your divorce and why, any accusation of abuse, any court order/restriction. etc...

 

Please dont take personal or offended, those are just questions that came to my head,  knowing what was, will help you help you better prepare for the next step.

 

Dont give up... it is just a bump in the road... you both will be here and happy.

There is more to this.  Has she been petitioned before?  What is the age difference?  There is more to the story.  I rarely see denials from the Philippines without a good reason.  WE were denied and ended up getting married in the Philippines.  I think that is your best route too.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Hmmmm read up a few posts. They said the embassy told them they don’t believe they’re a bonafide couple. And then they told them the petition is being sent to USCIS. That’s the end of the road, dude.

I agree that there has to be something else to the situation.   Everything they described seems ideal for an approval.. yet they were denied.

Age gap isn't it.   Largest age gap I seen come through was 37 years.. they were approved.

I didn't think so either.  I have seen many age gaps over 20 to 30 years that all got approved.  I am surprised that the 221g didn't have any more info or maybe they just aren't  sharing it.  We knew exactly why we were denied and so did the other people here who I've spoken to who were denied.

You need to go over every question and answer, every comment or look from the person interviewing her. Denials of k1 in the phillipines are rare, as others have said something always comes up part way through the thread that explains it. It might seem insignificant to you but it may be something that they view differently.

 

What does/did your fiancé do for a living?

Where does she live - in the same place as her parents? 

You said you became exclusive on your first trip - was she talking to other Americans or was it that you were talking to other Filipinas before that? 

Is she older than you?
