I-130 and 1485 interview

Hi guys I need help. I filed forms i130 and paid the correct fees. I received a record number and USCIS cashed the check...mo the later I received a rejection letter for invalid payment and that documents will be returned.  I never received anything back.  My attorney refiled the i130 and explained the correct fee and that the check has been cashed. 2 months later another rejection notice about incorrect fees. We had also filed for i485, I did the biometrics and just received appointment update online for the i485. 

What should I do. The payment issue is a USCIS error as we paid $535 and they cashed it. 

 

Any advice would be really helpful

7/7/2018                    ready to be scheduled for interview

7/11/2018                  We are still reviewing your case and there are no updates at this time (email from USCIS)

8/22/2018                  We are still reviewing your case and there are no updates at this time (same email again)

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Why didn’t you make the payment to USCIS? Couldn’t the attorney just add your check to the paperwork? It shouldn’t matter who the check is from as long it’s the correct amount.

I just received a rejection notice saying that my form was submitted with extra remittance that is not required to process my application!! They took the $535 from my credit card and haven’t returned anything! I received my text message for receipt and I got an email saying, my case was being forwarded to the Potomac Serves Center! I called and was transferred to a higher up to get  a understanding as to why I received the rejection notice regarding overpayment (which I did not overpay, I payed the 535 fee), and I was told i need to call back in the morning and to speak someone then! I’m so confused and a little worried! But I all can do is wait and call tomorrow. I wonder, have anyone else got a rejection notice and it was a glitch in the system! I really think it is! And yours might be too! It makes no sense to take a payment and then return it.

I just spoke to an Officer, and she gave me instructions to email Lock box support, regarding the notice I received and also my original receipt. She did inform that my case was not rejected and that USCIS could have over charged my card. I don’t think thats the case because I only see one charge for 535. It’s annoying that we have to wait to speak with people regarding our love ones being with us, but we gotta go through the motions and keep the faith that everything will work out fine. Good luck to you! But if you need to, contact USCIS and ask what’s going on with your payments, someone will speak with you and give you clarity, I’m sure!!

The attorney office have a policy to make payments to them directly  so that they can track payments and yes they did put a copy of the check that was initially paid on the i130 second submission. 

They sure did a great job of tracking those payments.
