Hi,

 

I have a question about my h1b visa.

I am on h1b and will be expired in this year. Also I am processing my gc thru my marriage since last month. Can I still work at my h1b company? Some lawyers said once I received my receipt number, I can not work anymore.

Yes, your adjustment of status doesn't affect your H1B visa, however, when it expires, you'll need to wait for your EAD before you can start to work again. If you're very lucky, you'll receive your EAD before your visa expires, but I wouldn't count on it.

 

Depending on your company, if you explain the situation to them, they might keep your job open for you while waiting for your EAD if there's a gap.

Considering you filed in July (let's say end of July), if you're very lucky, you may receive your EAD by the end of November (4 months mark). But since current processing time for I765 at National Benefit Center is 5-7 months (meaning that you should receive your EAD by the end of the year or early next year before Feb), I'd suggest you file for an expedition a month prior to your current EAD expiration date. Your employer can either help you to send out a letter saying you will have to be terminated if your new EAD doesn't arrive before your current one expires. Or if they want to terminate you by the end of your current EAD, you can use the termination letter to file for expedition anyway.

 

For now you still have to work for your company since they sponsored your H1B. But after your new EAD is approved and arrives, you can work for anybody.

Hi,

 

Citing your job loss  in November you can raise an SR  to expedite your EAD and AP.

Please try that route.

You just need to call the USCIS number and provide your receipt number for I 765 and AP and request them to expedite.

Then you might need to fax the proof to them.
